When is the deadline for submitting the list of legal apprentices proposed to participate in the examination to the Vietnam Bar Federation and the Department of Justice?

According to Article 18 of Circular 10/2021/TT-BTP, which regulates the organization of the legal apprenticeship examination:

Organization of the examination of the results of legal apprenticeship:

1. The examination of the results of legal apprenticeship is conducted at least once every six months.

2. No later than the 15th of the last month of the quarter, the Executive Committee of the Bar Federation shall submit the list of proposed legal apprentices to participate in the examination to the Vietnam Bar Federation and the Department of Justice, where the Bar Federation is headquartered.

The documents required for participating in the examination include:

a) The request form to participate in the examination, according to the template issued with this Circular.

b) A certified copy of the legal apprenticeship certificate.

c) A certified copy of the Bachelor's degree in Law or the Master's degree in Law.

d) A report on the legal apprenticeship process, accompanied by the legal apprenticeship journal as required by this Circular.

dd) A certified copy of the document proving the eligibility for a reduced legal apprenticeship period, as stipulated in clauses 2 and 3 of Article 16 of the Lawyers Law.

3. For individuals whose legal apprenticeship examination certificate has expired, the documents for participating in the examination are sent to the Vietnam Bar Federation. The documents include:

a) The request form to participate in the examination, according to the template issued with this Circular.

b) The expired legal apprenticeship examination certificate.

Therefore, the deadline for submitting the list of legal apprentices proposed to participate in the examination to the Vietnam Bar Federation and the Department of Justice, where the Bar Federation is headquartered, is no later than the 15th of the last month of the quarter.

What content does the examination of the results of legal apprenticeship in Vietnam assess?

According to Article 17 of Circular 10/2021/TT-BTP, the regulation regarding the content and form of the examination of the results of legal apprenticeship is as follows:

Content and form of the examination of the results of legal apprenticeship:

1. The examination content includes:

a) Skills in participating in litigation.

b) Legal advisory skills.

c) Skills in representing clients outside of litigation and providing other legal services.

d) Laws related to lawyers and the legal profession, the Code of Ethics and Professional Conduct for lawyers in Vietnam.

dd) Other skills as stipulated in Article 6 of this Circular.

2. The examination form includes a written examination and a practical examination.

a) The written examination consists of two tests:

The first written test assesses the skills in participating in litigation, legal advisory skills, and skills in representing clients outside of litigation and providing other legal services. The time allocated for the first written test is 180 minutes.

The second written test focuses on laws related to lawyers and the legal profession, the Code of Ethics and Professional Conduct for lawyers in Vietnam. The time allocated for the second written test is 90 minutes.

b) The practical examination:

Candidates present and defend their views on a self-selected case or matter they were involved in during their apprenticeship period and answer questions related to the case or matter posed by the members of the Examination Board.

Therefore, the content assessed in the examination of the results of legal apprenticeship includes:

- Skills in participating in litigation.

- Legal advisory skills.

- Skills in representing clients outside of litigation and providing other legal services.

- Laws related to lawyers and the legal profession, the Code of Ethics and Professional Conduct for lawyers in Vietnam.

- Other skills as stipulated.
