What documents are included in the application for lawyer apprenticeship registration in 2024 in Vietnam?

According to Article 5 of Circular 10/2021/TT-BTP, the lawyer apprenticeship registration is regulated as follows:

1. Individuals who meet the requirements specified in Clause 1 of Article 3 of this Circular shall register as law apprentices at the Bar Association where the professional organization of lawyers is headquartered.

2. The application for lawyer apprenticeship registration includes:

a) Request form for lawyer apprenticeship registration according to the form issued with this Circular;

b) Confirmation letter of acceptance as a law apprentice from the professional organization of lawyers accepting law apprentices;

c) Copy of Bachelor's degree in Law or Master's degree in Law;

d) Copy of Certificate of completion of legal profession training in Vietnam or copy of Decision on recognition of legal profession training abroad or copy of documents proving the reduction of law apprentice period for lawyers as specified in Clause 2 and Clause 3 of Article 16 of the Lawyers Law.

3. Within a period of 05 working days from the date of receiving a complete and valid application, the Head of the Bar Association shall record the name of the law apprentice in the list of law apprentices of the Bar Association and issue a Certificate of law apprentice to the law apprentice according to the form issued with this Circular; in case of refusal, it must be notified in writing and the reason must be stated. The rejected person has the right to appeal according to the provisions of this Circular.

Within a period of 07 working days from the date of issuing the Certificate of law apprentice, the Head of the Bar Association shall send a written notification to the professional organization of lawyers accepting law apprentices.

Therefore, in 2024, the application for lawyer apprenticeship registration includes:

- Request form for lawyer apprenticeship registration;

- Confirmation letter of acceptance as a law apprentice from the professional organization of lawyers accepting law apprentices;

- Copy of Bachelor's degree in Law or Master's degree in Law;

- Copy of Certificate of completion of legal profession training in Vietnam or copy of Decision on recognition of legal profession training abroad or copy of documents proving the reduction of law apprentice period for lawyers.

In addition, applicants for registration as law apprentices must meet the following conditions:

- Being a Vietnamese citizen loyal to the Fatherland, complying with the Constitution and laws, having good moral character;

- Having a Bachelor's degree in Law or Master's degree in Law;

- Having a Certificate of completion of legal profession training in Vietnam or a Decision on recognition of legal profession training abroad or documents proving exemption from legal profession training but subject to law apprentice period as prescribed.

What does the content of the lawyer apprenticeship include in Vietnam?

According to Article 6 of Circular 10/2021/TT-BTP, law apprentices will learn the following contents:

- Laws on lawyers and legal profession, Code of Ethics and Professional Conduct of Vietnamese lawyers.

- Skills in researching, collecting documents, and proposing solutions for case files.

- Skills in participating in litigation as defense counsel for arrested persons, detained persons, defendants, or as advocates for the rights of victims, plaintiffs, persons with rights and obligations related to criminal cases.

- Skills in participating in litigation as representatives or advocates for the rights and legitimate interests of plaintiffs, defendants, persons with rights and obligations related to civil disputes, marriage and family, business, commerce, labor, administration, civil demands, marriage and family, business, commerce, labor, and other cases and matters as prescribed by law.

- Legal advisory skills.

- Skills in representing clients outside of litigation to perform tasks related to the law.

- Skills in performing other legal services.
