Which agency promulgates the Code of Ethics and Professional Conduct for lawyers in Vietnam?

Pursuant to Clause 5.a of the Regulations of Vietnam Bar Federation issued together with the Decision 856/QĐ-TTg in 2022 stipulating as follows:

5. The National Bar Council has the following tasks and powers:

a) Promulgate the Code of Ethics and Professional Conduct for Vietnamese Lawyers;

b) Decide on policies and measures to implement the resolutions and decisions of the National Congress of Lawyers;

c) Approve the work report, financial report, and annual program of activities of the Federation;

As regulations above, the National Bar Council is responsible for promulgating the Code of Ethics and Professional Conduct for Vietnamese lawyers.

Can the National Bar Council of Vietnam meet online?

Pursuant to Clause 6 of the Regulations of Vietnam Bar Federation issued together with the Decision 856/QĐ-TTg in 2022 stipulating as follows:

6. The National Bar Council meets regularly, at least once a year, at the convocation of the Federation's Standing Committee. The National Bar Council may meet in person or online.

The Federation's Standing Committee may convene an extraordinary meeting of the National Bar Council to decide on matters falling within the Council's jurisdiction when there are more than half of the members of the Federation's Standing Committee or one-third of its members. A council member requested

Meetings of the National Bar Council are valid when at least 2/3 of the Council members participate.

In case the Bar Association vacates the chairmanship, the vice president in charge is invited to attend meetings of the National Bar Council but is not entitled to vote.

The National Bar Council may meet in person or online according to the above provisions.
