When shall an apprentice who has terminated their apprenticeship register for re-apprenticeship in Vietnam?
According to Clause 3, Article 11 of Circular 10/2021/TT-BTP, there are provisions for cases where an apprentice who has terminated their apprenticeship can register for re-apprenticeship:
An apprentice who has terminated their apprenticeship can be considered for re-apprenticeship registration when they meet the apprenticeship conditions for practicing law as stipulated in Clause 1, Article 3 of this Circular and fall into one of the following cases:
- Cases stipulated in points a, i, k, and 1 of Clause 2 of this Article; cases stipulated in points b, c, d, and dd of Clause 2 of this Article when the reasons for terminating the apprenticeship no longer exist;
- Have had their criminal record expunged, except for cases of conviction for serious crimes due to intentional acts, very serious crimes due to intentional acts, and extremely serious crimes due to intentional acts;
- Have completed administrative handling measures into compulsory detoxification centers, compulsory educational institutions according to the provisions of the law on the handling of administrative violations;
- After a period of 01 year from the date the disciplinary decision in the form of temporary suspension of the apprenticeship for practicing law from 03 months to 06 months takes effect, or after a period of 03 years from the date the disciplinary decision in the form of removal from the list of apprentices of the Bar Association takes effect.
The procedure for re-apprenticeship registration is carried out according to the provisions of Article 5 of this Circular.
Conditions for re-apprenticeship registration in Vietnam
The conditions for re-apprenticeship registration are stipulated again in Clause 1, Article 3 of Circular 10/2021/TT-BTP, specifically:
Individuals who meet the following conditions are eligible to register for an apprenticeship in practicing law:
- Vietnamese citizens who are loyal to the Fatherland, comply with the Constitution and the law, and possess good moral character;
- Possess a Bachelor of Laws degree or a Master of Laws degree;
- Hold a certificate of graduation from lawyer training in Vietnam, or a decision recognizing lawyer training abroad, or documents proving exemption from lawyer training but falling into cases required to undergo a legal practice apprenticeship according to the provisions of Clause 2, Article 16 of the Law on Lawyers.
