Internship Period and Extension for Practicing Law

The internship period and extension for practicing law are stipulated in Article 10 of Circular 10/2021/TT-BTP. To be specific:

- The internship period for practicing law is 12 months, starting from the date the Management Board of the Bar Association registers the internship; for those who receive a reduced internship period according to Clause 2, Article 16 of the Law on Lawyers, the internship period is 04 months; for those who receive a reduced internship period according to Clause 3, Article 16 of the Law on Lawyers, the internship period is 06 months.

- The intern may receive an extension of the internship period for practicing law from the Management Board of the Bar Association if they do not meet the internship requirements as evaluated by the mentoring lawyer and the law practice organization that accepted the intern.

Within 05 working days from the date of receiving the extension request from the intern, the Management Board of the Bar Association shall issue a decision to extend the internship period for practicing law.

Within 07 working days from the date of issuing the extension decision for the internship period, the Management Board of the Bar Association shall send a written notice to the law practice organization that accepted the intern, the intern, the Vietnam Bar Federation, and the Department of Justice where the Bar Association is headquartered.

- The intern may have the internship period extended a maximum of 02 times, each time for 06 months. If, after the second extension, the intern still does not meet the requirements, the Management Board of the Bar Association where the internship is registered shall issue a decision to remove the intern's name from the internship list of the Bar Association. The person whose name has been removed from the internship list has the right to appeal in accordance with this Circular.

The person whose name has been removed from the internship list of the Bar Association must re-register for the legal internship in accordance with Article 5 of this Circular. The internship period for such an intern shall be carried out as stipulated in Clause 1 of this Article.

- During the internship extension or re-internship, the intern must keep an Internship Logbook and report the internship process as stipulated by this Circular.

=> Therefore, according to the aforementioned regulations, the internship period for practicing law starts from the date the Management Board of the Bar Association registers the internship, and the internship period is 12 months.
