What is form correction of the judicial expert card in Circular 11/2020/TT-BTP in Vietnam?

Recently, the Ministry of Justice has just issued Official Dispatch 1423/BTP-BTTP of 2023 on correcting the judicial expert card form in Circular 11/2020/TT-BTP.

In Official Dispatch 1423/BTP-BTTP of 2023 due to technical negligence, the Ministry of Justice requested to correct 01 error in the form of the judicial expert card issued with Circular No. 11/2020/TT-BTP as follows:

In form No. 01 (illustration section), the front background of the judicial expert card is the image of the national emblem.

Now I would like to amend it to "The front background is an image of a bronze drum and patterns, decorative motifs, yellow" (According to the Appendix attached to this Official Dispatch).

In Form No. 1, the judicial expert card model issued with Circular No. 11/2020/TT-BTP stipulates that the front background of the judicial expert card is the image of the national emblem as follows:

In the Appendix attached to Official Dispatch 1423/BTP-BTTP of 2023, there is a request to correct the judicial expert card sample with "The front background is an image of a bronze drum and patterns, decorative motifs, and yellow color" as follows: 

What is content on the front of the judicial expert card in Vietnam?

In Clause 2 and Clause 3, Article 4 of Circular 11/2020/TT-BTP, there are regulations on the front of the re-issuance of the judicial expert card as follows:

(1) The content of the front side, adjacent to the left margin, from top to bottom includes the following information:

- The top corner is the name of the agency issuing the judicial expert card, presented in capital letters, font size 6, vertical, bold font. Below the name of the agency issuing the judicial expert card, there is a solid line with a length equal to 1/3 to 1/2 the length of the text and centered;

- Photo of the person issued a judicial expert card (2cm x 3cm), centered under the name of the agency issuing the judicial expert card.

(2) The content of the front side, adjacent to the right margin, from top to bottom includes the following information:

- Country’s official name: "SOCIALIST REPUBLIC OF VIETNAM": Presented in capital letters, black, font size 6, vertical font, bold and at the top;

- Motto: "Independence - Freedom - Happiness": Presented in lowercase letters, black, font size 6, vertical font, bold and centered under the Country’s official name; The first letter of the phrases is capitalized, there is a hyphen (-) between phrases, and there are spaces. Below the motto, there is a solid line whose length is equal to the length of the line and is aligned in the middle of the motto;

- The words "JUSTICE EXPERT CARD": Presented in capital letters, red color, font size 8, vertical, bold font; centered under the Title;

- Card number: Includes the ministry code, ministerial-level agency, and province code as prescribed in Clause 2, Article 9 of this Circular and the next 4 digits are the card's serial number, numbered consecutively from 0001 written in Arabic;

- Card symbol includes: Abbreviation of card name and abbreviation of name of card-issuing agency, presented in capital letters, font size 8, vertical font.

The card number and card symbol are aligned between the words "JUSTICE EXPERT CARD";

- Full name of the card holder: Presented in lowercase letters, black, font size 8, vertical, bold font;

- Date, month and year of birth of the card holder: Write in Arabic numerals;

- Inspection field: Presented in lowercase letters, black, font size 8, vertical font;

- Place of work: Presented in lowercase letters, black, font size 8, vertical font (clearly state the unit under the ministry, ministerial-level agency or unit under the Provincial People's Committee);

- Place of issue, date, month, year of issue: Presented in lowercase letters, font size 8, italic font, number, date, month, year written in Arabic numerals;

- Position of person with authority to issue cards (Minister/Head of ministerial-level agency, Chairman of Provincial People's Committee): Presented in capital letters, font size 6, vertical, bold font;

- Full name of the signer: Presented in lowercase letters, black, font size 6, vertical, bold font.

In what cases is the judicial expert card reissued in Vietnam?

In Clause 1, Article 8, Circular 11/2020/TT-BTP has regulations on re-issuance of judicial expert cards as follows:

Reissue of judicial expert card

1. The judicial expert card is reissued in case the issued card is lost, damaged (torn, dirty, blurred) and cannot be used or there is a change in the information recorded on the card.

2. Dossier to request re-issuance of judicial expert card includes:

a) Application for re-issuance of judicial expert card.

In case the card is lost or the content written on the card has changed, the application for re-issuance of the judicial expert card must be certified by the managing agency or unit.

b) The judicial expert card is being used in case there is a change in the information recorded on the card; judicial expert card in case the old card is damaged;

c) 02 color portrait photos sized 2cm x 3cm (taken within the last 6 months) of the person requesting re-issuance of the judicial expert card.

Thus, the judicial expert card is reissued in the following cases:

- The issued card is lost, damaged (torn, dirty, blurred) and cannot be used;

- There is a change to the information recorded on the card.
