The circular stipulates the following regulations:

- Issuing a Certificate of Acceptance of Trainee Lawyer to the trainee, assigning a qualified lawyer as per the requirements of this circular to guide the trainee, and being responsible for the assignment.

- Signing a labor contract with the trainee, ensuring the rights and obligations of the trainee, and creating favorable conditions for the trainee and the guiding lawyer at the organization.

- Establishing, managing, and using a Trainee Record Book for the trainee at the organization, following the template provided in this circular.

- Monitoring and inspecting the compliance with the rights and obligations of the guiding lawyer and the trainee as per the provisions of this circular.

- Managing the trainee during the training period at the organization, mediating disputes between the guiding lawyer and the trainee.

- Refusing to accept trainees if they do not meet the requirements stated in Article 3, Section 1 of this circular, or if the organization does not have a qualified lawyer to guide the trainee as per the provisions of this circular. Termination of trainee guidance in case the trainee is disciplined in accordance with points c and d of Section 1, Article 33 of this circular.

- Considering the refusal or change of the guiding lawyer.

What is the content of trainee lawyers' practice as part of their professional training in Vietnam?

The content of trainee lawyers' practice are stipulated under Article 9 of Circular 10/2021/TT-BTP (effective from January 25, 2022) as follows:

Submitting written reports to the Department of Justice and the Lawyers' Association at the location of the legal professional organization accepting trainee lawyers, regarding the organization and its activities in compliance with the law. The report should also include information about the trainee lawyers, covering the following aspects:

- The number of trainee lawyers at the legal professional organization.

- Evaluation of the quality of the trainee lawyers' practice.

- Compliance with the rights and obligations of the legal professional organization, guiding lawyers, and trainee lawyers as specified in this circular.

- Difficulties or obstacles encountered during the trainee program, along with proposals and recommendations.
