What are regulations on Law practice probation fee, Bar Association membership fee, membership fee in Vietnam?

Pursuant to Article 39 of the Regulations of Vietnam Bar Federation issued together with the Decision 856/QĐ-TTg in 2022 stipulating as follows:

1. When registering to practice law as a trainee, the intern shall pay a fee to the Bar Association. The law practice probation fee rate shall be decided by the Bar Conference based on the fee bracket set by the National Bar Council.

2. Persons eligible to join the Bar Association must pay a joining fee to the Bar Association. The entry fee level and the cases in which the Bar Association membership fee is exempted or reduced shall be decided by the Bar Conference based on the fee bracket set by the National Bar Council.

3. Lawyers are obliged to pay the membership fees of the Vietnam Bar Federation and the membership fees of the Bar Association.

Lawyers pay the Federation membership fee by transferring funds to the Federation's account or paying in person at the Vietnam Bar Federation's office or the Vietnam Bar Federation's representative office in Ho Chi Minh City; they pay the Bar Association membership fee by transferring funds to the Bar Association's account or paying in person at the Bar Association Office.

Union membership fee, Bar Association membership fee; the National Bar Council shall specify the circumstances under which Federation membership fees and Bar Association membership fees may be waived or reduced.

4. The Board of Directors and the President of the Bar Association are responsible for reviewing and urging the lawyers who are members of their union to pay the Federation and Bar Association membership fees.

Every six months, the Vietnam Bar Federation shall coordinate with the Bar Association to make a public announcement on the website of the Vietnam Bar Federation, the Vietnam Bar Magazine, and the website of the Law Union listing lawyers who have paid membership fees and lawyers who have not yet paid the membership fees of the Vietnam Bar Federation and the Bar Association.

Every six months, the Board of Directors of the Bar Association shall summarize the list of member lawyers who have not yet paid membership fees to the Federation and Bar Association members and notify the member lawyers; send the Vietnam Bar Federation the list of lawyers who have not paid the Federation membership fee and Bar Association membership fee for six months or more no later than January 31 and July 31 of each year.

5. Lawyers who fail to pay Vietnam Bar Federation membership fees or Bar Association membership fees shall be handled according to the following provisions:

a) For the last six months to a year, the Vietnam Bar Federation will remind on the Federation and Bar Association websites, as well as provide a written reminder for the first time or through other means.

b) From 12 months to under 18 months, the Vietnam Bar Federation will remind on the website of the Federation and the Bar Association on the website of the Bar Association, remind in writing for a second time, or by other means:

c) After 18 months, they will be disciplined by having their names removed from the Vietnam Bar Federation and Bar Association's list of lawyers.

How do lawyers in Vietnam pay union membership fees?

3. Lawyers are obliged to pay the membership fees of the Vietnam Bar Federation and the membership fees of the Bar Association.

Lawyers pay the Federation membership fee by transfer to the account of the Vietnam Bar Federation or directly at the Office of the Vietnam Bar Federation or the representative office of the Vietnam Bar Federation in Ho Chi Minh City. Ho Chi Minh City; pay the Bar Association membership fee by transfer to the account of the Bar Association of which he is a member or directly at the Bar Association Office.

Union membership fee, Bar Association membership fee; the cases of exemption or reduction of Federation membership fees and Bar Association membership fees shall be prescribed by the National Bar Council.
