Unilateral Termination of Contract by Lawyer: Is Client Notification Required?
Based on Rule 14 of the Code of Conduct issued under Decision 201/QD-HDLSTQ in 2019 stipulating the resolution when a lawyer unilaterally terminates the provision of legal services as follows:
When unilaterally terminating the provision of legal services under Rule 13, the lawyer should maintain a respectful attitude towards the client, provide written notification to the client within a reasonable period to allow the client to find another lawyer, and promptly resolve any issues related to the termination of the signed legal service contract.
Thus, in the above case, the lawyer needs to notify the client in writing within a reasonable period to allow the client to find another lawyer, and promptly resolve any issues related to the termination of the legal service contract.
