In which cases will a member of the Vietnam Lawyers Association have their membership terminated?

Based on Clause 5, Article 10 of the Charter of the Vietnam Lawyers Association attached to Decision 770/QD-TTg of 2020, the regulations are as follows:

Conditions, procedures for admission of members, transfer of association activities, exemption from association activities, withdrawal from the association

  1. Conditions and procedures for admission of members

Vietnamese citizens who meet all the standards stipulated in Article 8 of this Charter and wish to join the Association must voluntarily apply for membership and submit a dossier to the Executive Committee of the affiliated Lawyers Union.

The Executive Committee of the affiliated Lawyers Union shall receive and consider the dossier, and then propose it to the Standing Committee of the higher-level Lawyers Association for decision.

In case the applicant is in an area without an Association organization, the dossier should be sent to the competent Standing Committee of the Lawyers Association for consideration and admission. The Standing Committee of the Association that has made the decision for admission is responsible for introducing the new member to the Association organization where there are the most favorable conditions.

The applicant is recognized as a member from the date of the admission decision.

  1. Transfer of association activities

A member is entitled to transfer association activities when they change their workplace or residence according to the principle: Members residing or working where there is no Association organization shall participate in the Association activities at their residence. If both the workplace and residence lack an Association organization, the member shall participate in the activities of the Association organization with the most favorable conditions.

  1. Exemption from association activities

A member may be exempted from association activities if there are valid reasons that prevent them from participating regularly.

  1. Withdrawal from the association

A member who wishes to withdraw from the Association must submit a request to the Executive Committee of the affiliated Lawyers Union where they are participating for consideration and propose it to the competent authority for decision.

5. Automatic termination of membership when:

a) The member dies;

b) The member does not participate in activities and does not pay membership fees for two consecutive years or more.

- The member does not participate in activities and does not pay membership fees for two consecutive years or more.

What rights does a member of the Vietnam Lawyers Association have?

Based on Article 8 of the Charter of the Vietnam Lawyers Association attached to Decision 770/QD-TTg of 2020, the rights of the members are as follows:

- Granted membership card.- Provided with information related to the operational field of the Association and participate in activities organized by the Association.- Trained to enhance legal knowledge and professional skills.- Participate in discussing and deciding on the Association’s work plans according to the Association's regulations.- Attend the Congress, nominate, stand for elections, and vote to elect leaders and committees of the Association following the Charter of the Vietnam Lawyers Association.- Introduce new members.- Receive awards according to the Association's regulations.- Appeal against the Association's decisions, denounce acts infringing member's rights and interests, and the organization of the Association according to the law and the Association's Charter.- Request the Association to protect lawful rights and interests following the law and the Charter of the Vietnam Lawyers Association.- Transfer the place of association activities, exempt from association activities, or withdraw from the Association when unable to continue as a member as prescribed.

What duties does a member of the Vietnam Lawyers Association have?

Based on Article 9 of the Charter of the Vietnam Lawyers Association attached to Decision 770/QD-TTg of 2020, the duties of the members are as follows:

- Strictly adhere to the guidelines and policies of the Communist Party, State laws and regulations, and the Association's Charter.- Participate in and support the activities of the Association; unite and cooperate with other members to strengthen the Association.- Protect the reputation of the Association, and not engage on behalf of the Association in transactions unless assigned in writing by the Association's leaders.- Perform tasks assigned by the Association.- Adhere to policies and report according to the Association's regulations.- Pay membership fees in full and on time according to the Association's regulations.
