Termination of Legal Internship: Regulations and Frequency of Intern Suspension
How is the termination of the legal practice internship regulated?
The termination of the legal practice internship is stipulated in Clause 2, Article 11 of Circular 10/2021/TT-BTP, which specifies the cases for the termination of the legal practice internship:
The intern shall terminate the legal practice internship when falling under one of the following cases:
- Voluntarily terminates the legal practice internship;
- Recruited as officials and public employees; officers, professional soldiers, or defense workers in agencies or units under the people's army; officers, non-commissioned officers, or workers in agencies or units under the people's police;
- No longer a permanent resident in Vietnam;
- Lost or restricted capacity for civil acts; having difficulty in cognition, controlling acts according to civil law;
- Under criminal investigation;
- Convicted by a legally effective judgment;
- Subject to administrative measures by being sent to mandatory rehabilitation centers or mandatory educational institutions;
- Disciplined with the suspension of the legal practice internship from 03 months to 06 months or removed from the list of interns of the Bar Association;
- Suspended the internship more than the prescribed number of times or has exhausted the suspension period as stipulated in Clause 1 of this Article without resuming the internship;
- Interns discovered not meeting the conditions stated in Clause 1, Article 3 of this Circular;
- Removed from the list of interns of the Bar Association as stipulated in Clause 3, Article 10 of this Circular.
The internship period before termination as defined in Clause 2 of this Article shall not be counted towards the total internship period.
How many times can a legal practice intern suspend their internship?
The number of times a legal practice intern can suspend their internship is stipulated in Clause 2, Article 11 of Circular 10/2021/TT-BTP, which covers the cases of terminating the legal practice internship:
An intern may suspend the legal practice internship after reaching a written agreement with the legal practicing organization accepting the internship and must report in writing to the Bar Association where the internship is registered.
The intern can suspend the internship a maximum of 02 times, each time not exceeding 03 months. The internship period before the suspension shall be counted towards the total internship period of the legal practice internship.
=> Therefore, according to the mentioned regulations, the intern can suspend the internship a maximum of 02 times, each time not exceeding 03 months.
