Procedure for Correcting Incorrect Driving License Information According to Regulations

Question:

Hello editorial board,I am currently 18 years old. I took the driving test 1 month ago and was issued a driver's license yesterday. However, the name on my driver's license does not match the name on my birth certificate and ID card. I want to change my driver's license to reflect the correct name as on my ID card to ensure consistency and avoid future complications. Could you please inform me of the sequence, procedures, and tasks I need to undertake to have my incorrectly specified driver's license reissued according to the regulations?Thank you in advance for your guidance.

1. Legal Grounds:

+ Road Traffic Law 2008;

+ Joint Circular 24/2015/TTLT-BYT-BGTVT;

+ Circular 12/2017/TT-BGTVT;

+ Circular 188/2016/TT-BTC;

2. Conditions for Replacing Driver's Licenses

- Replace the driver's license in case the year of birth, last name, first name, or middle name recorded on the driver's license differs from the information on the identity card or citizen identification card.

- Do not replace the driver's license in the following cases:

+ Temporary driver's license from a foreign country; international driver's license; foreign driver's license, military, police driver's license expired as per regulations, erased, torn and lacking necessary elements to replace the driver's license, or with differences in identification; foreign driver's license not issued by a competent authority;

+ Driver's license of the transportation sector but not in the driver’s license information system, the list of licenses issued (management book);

+ Decision of military discharge over 06 months up to the date of applying for license replacement for military driver's license issued by the Ministry of National Defense;

+ Persons not meeting the health standards as per regulations.

3. Application Dossier for Replacing Driver's License

+ Replacement application form as prescribed in Appendix 19 issued with Circular 12/2017/TT-BGTVT;

+ Original dossier matching the driver's license (if any);

+ Health certificate of the driver issued by a competent medical institution as prescribed, except for the case of indefinite-term license reissuance for categories A1, A2, A3;

+ A copy of the identity card or citizen identification card or passport within validity period, indicating the number of the identity card or citizen identification card (for Vietnamese citizens), or passport within validity period (for foreigners, overseas Vietnamese).

4. Submission Method:

- Submit directly at the Directorate for Roads of Vietnam or the Department of Transport.

5. Responsible Agency:

- Directorate for Roads of Vietnam or Department of Transport.

6. Processing Time:

- No more than 05 working days from the date of receiving the complete application as per regulations.

7. Fee (if any): 135,000 VND/time.
