Regulations on Organizing the Examination of Probation Results for Practicing Law

The organization of the examination of probation results for practicing law stipulated in Clause 4, Article 18 of Circular 10/2021/TT-BTP, (effective from January 25, 2022) specifically includes:

- The examination of probation results for practicing law shall be organized at least once every 6 months.

- No later than the 15th day of the last month of the quarter, the Executive Board of the Bar Association shall send the list of probationers proposed to participate in the examination to the Vietnam Bar Federation and the Department of Justice where the Bar Association’s headquarters are located.

Documents for participating in the examination include:

+ Application form to participate in the examination according to the template issued with this Circular;

+ A copy of the Certificate of Probation for Practicing Law;

+ A copy of the Bachelor of Laws degree or a copy of the Master of Laws degree;

+ A report on the probation process for practicing law accompanied by a Probation Diary as stipulated by this Circular;

+ A copy of documents proving eligibility for reduced probation time for practicing law according to the provisions in Clause 2 and Clause 3, Article 16 of the Law on Lawyers.

- For individuals whose Certificate of Examination of Probation Results for Practicing Law has expired, the examination application should be sent to the Vietnam Bar Federation. The application includes:

+ Application form to participate in the examination according to the template issued with this Circular;

+ The expired Certificate of Examination of Probation Results for Practicing Law.

How many times a year is the examination of probation results for practicing law organized?

In Clause 1, Article 18 of Circular 10/2021/TT-BTP, (effective from January 25, 2022) it is specifically stated:

The examination of probation results for practicing law shall be organized at least once every 6 months.

=> Therefore, as per the above regulation, the examination of probation results for practicing law is organized at least once every 6 months (twice a year).
