1. Only the Judicial Academy of the Ministry of Justice trains notary professions in Vietnam?
Based on Article 7 of Circular 01/2021/TT-BTP, which stipulates the training institution for notary professions, and the framework training program for notary professions as follows:
The training institution for notary professions as stipulated in Article 9 of the Notary Law is the Judicial Academy under the Ministry of Justice.
The Judicial Academy presides and cooperates with the Department of Legal Support to develop and submit the framework training program for notary professions to the Minister of Justice for issuance.
Thus, in Vietnam, the institution for training notary professions is the Judicial Academy under the Ministry of Justice.
Where is the refresher course for the notary profession organized?
According to Article 9 of Circular 01/2021/TT-BTP, which stipulates the registration to participate in the refresher course for notary professions as follows:
1. Those who are exempt from notary profession training as stipulated in clause 1, Article 10 of the Notary Law, shall submit directly or send via postal system 01 dossier for registration to participate in the refresher course for notary professions to the Judicial Academy. The dossier includes the following documents:
a) Registration form to participate in the refresher course for notary professions (Form TP-CC-02);
b) Documents proving exemption from notary profession training as stipulated in clause 2, Article 3 of this Circular.
- The Judicial Academy receives the registration dossiers and announces the list of those eligible to participate in the refresher course no later than 30 days before the opening date; in case of refusal, a written notification stating the reasons must be provided.
Those who are exempt from notary profession training submit their registration dossiers to participate in the refresher course for notary professions to the Judicial Academy. Consequently, the Judicial Academy is the institution that organizes the refresher course for notary professions.
