May a person with a speech impediment become a lawyer in Vietnam?
Article 10, Article 11 of the Law on Lawyers 2006 stipulates as follows:
Article 10. Standards for lawyers
A Vietnamese citizen who is loyal to the Fatherland, complies with the Constitution and the law, possesses good moral qualities, holds a bachelor's degree in law, has undergone lawyer training, has completed a period of law practice internship, and is in good health to practice law can become a lawyer.
Article 11. Conditions for practicing law
A person who meets the standards stipulated in Article 10 of this Law and wishes to practice law must have a law practice certificate and join a Bar Association.
Therefore, the current law does not specifically stipulate whether a person with a speech impediment can become a lawyer. Hence, you can still pursue a career in law.
Shall a person with a speech impediment have their law practice certificate revoked in Vietnam?
According to Clause 9 Article 1 of the Amended Law on Lawyers 2012, a person who has been granted a law practice certificate and falls into one of the following cases shall have their law practice certificate revoked:
a) No longer meets the standards for lawyers stipulated in Article 10 of this Law;
b) Is recruited, appointed as officials and public employees; officers, professional soldiers, or defense workers in the agencies, units of the People's Army; officers, non-commissioned officers, or workers in the agencies, units of the People's Police;
c) No longer has permanent residence in Vietnam;
d) Fails to join a Bar Association within two years from the date of issuance of the Lawyer Practicing Certificate;
dd) Fails to establish or participate in the establishment or work under a labor contract for a law-practicing organization or register to practice as an individual within three years from the date of joining the Bar Association;
e) Voluntarily ceases practicing law;
g) Is disciplined by being removed from the list of lawyers of the Bar Association;
h) Is administratively fined in the form of temporary revocation of the law practice certificate; is subjected to administrative measures of being taken into compulsory detoxification centers, compulsory educational institutions;
i) Is convicted by a legally effective court judgment;
k) Is incapacitated for civil acts or limited in civil act capacity.
There is no provision regarding the revocation of the law practice certificate for a lawyer with a speech impediment.
