Is It Permissible to Sell a Notary Office?
Pursuant to Article 29 of the Law on Notarization 2014, the regulation on the transfer of notary offices is as follows:
- Notary offices may be transferred to other notaries who meet the conditions specified in Clause 2 of this Article. Notary offices can only be transferred after having operated for at least 2 years.
Notaries who transferred their Notary Offices are not allowed to participate in establishing new Notary Offices for a period of 5 years from the date of the transfer.
- Notaries receiving the transfer of Notary Offices must meet the following conditions:
a) Have practiced notarization for 2 years or more for those expected to take over the position of Head of the Notary Office;
b) Commit to practicing at the Notary Office they receive the transfer;
c) Commit to inheriting the rights and obligations of the transferred Notary Office.
The provincial-level People's Committee shall consider and decide to permit the transfer of the Notary Office.
the Government of Vietnam stipulates in detail the order and procedures for transferring Notary Offices.
Thus, it is entirely possible to sell, that is, to transfer when the conditions mentioned above between the seller and the buyer (the transferor and the transferee) are met.
