Is it Permissible to Receive Probationary Salary for Practicing Lawyers?
Pursuant to Article 9 of Circular/2013/TT-BTP, the rights of the apprentice are stipulated as follows:
To be guided by lawyers in updating legal knowledge, skills in participating in litigation, legal consulting skills, skills in representing outside litigation, performing other legal services, management skills, management of law practice organizations, the implementation of the Code of Ethics and Professional Conduct of Vietnamese Lawyers, rights, and obligations of the apprentice.
To assist the guiding lawyer in performing the tasks specified in Clause 3, Article 14 of the Law on Lawyers, and to contact individuals, agencies, and organizations to exercise rights, obligations, and activities related to defending, representing, protecting the legal rights and interests of clients or legal consulting activities.
To be provided with favorable conditions by the law practice organization and guiding lawyer during the apprenticeship period.
To request a change of guiding lawyer in the cases specified in Article 15 of this Circular.
5. Other rights as agreed upon with the law practice organization accepting the apprenticeship or as prescribed by law.
Thus, according to the above regulations, in the case of being an apprentice but having an agreement with the organization, the guiding person is paid a salary, this amount can entirely be received, as it somewhat contributes and supports the apprenticeship unit.
