Is it correct that lawyers in Vietnam are not permitted to unilaterally sign legal service contracts with clients?
Based on Clause 3g Article 6 of Decree 82/2020/ND-CP stipulating the activities of law practice:
- A fine from 7,000,000 VND to 10,000,000 VND for one of the following acts:
Signing a legal service contract with a client without approval or written authorization from the law practice organization.
Based on Clause 8a of this Article stipulating additional forms of penalties:
- Revocation of the law practice certificate or the foreign law practice license in Vietnam from 1 month to 3 months for violations of the provisions at points a, b, c, d, dd, and g of Clause 3, point a of Clause 5 of this Article.
Thus, if a lawyer in Vietnam signs a legal service contract with a client without approval or written authorization from the law practice organization, a fine from 7,000,000 VND to 10,000,000 VND and additional penalties will be imposed on this lawyer.
