Is a Trainee Lawyer Allowed to Continue the Internship if They Pass the Official Exam?
At Clause 2, Article 8 of Circular 19/2013/TT-BTP guiding the internship in legal practice stipulates:
The intern shall terminate the internship in legal practice when falling into one of the following cases:
- Voluntarily terminating the internship in legal practice;
- Being recruited as officials and public employees; officers, professional soldiers, defense workers in agencies, units belonging to the People’s Army; officers, non-commissioned officers, workers in agencies, units belonging to the People’s Public Security;
- No longer having permanent residence in Vietnam;
- Being convicted and the judgment has taken legal effect;
- Being subject to administrative handling measures to be sent to compulsory rehabilitation establishments, compulsory education establishments;
- Being disciplined in the form of suspension of legal practice internship for a period from three months to six months;
- Being disciplined in the form of removal from the list of interns of the Bar Association.
Thus, according to the aforementioned regulations, if during the internship period an intern passes the official exam, the legal practice internship shall be terminated.
