How Many Times is it Permissible to Suspend Lawyer Probation?
At Clause 1, Article 12 of Circular 05/2020/TT-BTP stipulates the number of times that the internship of a Bailiff can be temporarily suspended, as follows:
- A person undergoing an internship as a Bailiff may temporarily suspend their internship in case of a legitimate reason. A person with an internship duration of 6 months may temporarily suspend their internship up to 2 times, each time not exceeding 3 months; a person with an internship duration of 3 months may temporarily suspend their internship up to 1 time, not exceeding 3 months. The period of temporary suspension of the internship is not counted into the internship duration.
- The internship period before the temporary suspension is counted into the total internship duration, except the case of re-registering the internship according to the provisions of Clause 3 of this Article.
- Within 3 working days from the date of receipt of the written notification from the intern about the temporary suspension of the internship and within 3 working days from the date of the end of the temporary suspension period, the Bailiff's Office must notify in writing the Department of Justice where its head office is located to monitor the temporary suspension of the internship.
