How many member lawyers are needed for establishment of a Bar Association branch in the district in Vietnam?
Pursuant to Clause 5 Article 20 of the Regulations of Vietnam Bar Federation issued together with the Decision 856/QĐ-TTg in 2022 stipulating as follows:
5. A bar association with 1,000 or more members may establish a bar association branch in a district, district, or regional unit to help the bar association's board of directors manage and organize legal activities in the area. The Bar Association's branch is an affiliated unit of the Bar Association that operates under its management and reports to the Board of Directors of the Bar Association. The Head of the Bar Association is a member of the Executive Board of the Bar Association. The organizational structure, tasks, and powers of the Bar Association's branch are prescribed by the association's regulations. The Bar Congress shall decide on the establishment of a Bar Association branch.
Therefore, according to the above provisions, a bar association with 1,000 or more members can establish a bar association branch in a district or regional unit to help the bar association's board of directors manage and organize the activities of lawyers in the region.
Is the law office a affiliated unit of the Bar Association of Vietnam?
Pursuant to Clause 4 Article 20 of the Regulations of Vietnam Bar Federation issued together with the Decision 856/QĐ-TTg in 2022 stipulating as follows:
Agencies, specialized units and affiliated units of the Bar Association
1. The Bar Association's General Assembly is the highest-ranking body of the Bar Association.
2. The Bar Association Executive Board is the executive body of the Bar Congress and the executive body of the Bar Association.
3. The Commendation and Disciplinary Council is a specialized agency that advises the Executive Board of the Bar Association and has the responsibility and duty to consider, verify, conclude, and propose to the Board of Directors on commendation and discipline in law, settlement of complaints, and denunciations.
4. The Bar Association's office, specialized units, and affiliated units are established by the Bar Association to assist the Board of Directors in implementing the tasks and powers of the Bar Association.
In accordance with the above law, the Office of the Bar Association is an affiliated unit of the Bar Association.
