What is the guidance on calculating the professional responsibility allowance paid to legal aid assistants in Vietnam?
According to Article 11 of Decree 144/2017/ND-CP, provisions and policies for legal aid assistants in Vietnam are as follows:
1. Legal aid assistants hold professional titles as public employees in accordance with the law.
2. Legal aid assistants are entitled to a professional responsibility allowance equivalent to 25% of their current salary plus any leader allowance and extra allowance (if any).
3. Legal aid assistants are provided with uniforms according to the following standards and durations:
a) Suit: issued once every 2 years, initially 2 sets, thereafter 1 set each time;
b) Long-sleeve shirt: issued annually, initially 2 items, thereafter 1 item each time;
c) Spring-summer clothing: issued annually, initially 2 sets, thereafter 1 set each time;
d) Leather shoes: 1 pair per year;
dd) Heel-strap sandals: 1 pair per year;
e) Belt: 1 item every 2 years;
g) Tie: 1 item every 2 years;
h) Socks: 2 pairs per year;
i) Document bag: 1 item every 2 years;
k) Name tag: 1 item (issued once).
The Ministry of Justice shall elaborate on uniform models, management, issuance, and use of uniforms.
Thus, in addition to their salary, legal aid assistants in Vietnam are also entitled to a professional responsibility allowance equivalent to 25% of their current salary plus any leader allowance and extra allowance (if any).

According to Article 12 of Decree 144/2017/ND-CP, the period of legal aid provision serving as the basis for paying remuneration in Vietnam is stipulated as follows:
1. Remuneration for legal aid provision is determined based on the actual working time that the legal aid-providing person has spent directly on handling the legal aid case.
2. The period of legal aid provision serving as the basis for paying remuneration includes the time for meeting and interacting with the legally-aided person or their relatives, verification time for the legal aid case, working time at agencies, organizations, and individuals related to the legal aid case; time for studying case files, preparing documents at the legal aid implementing organization, and other reasonable time directly serving the handling of the legal aid case, based on the confirmation of the relevant agencies, organizations, or individuals.
