Do lawyers practicing as individuals have to purchase professional liability insurance themselves?
Based on Clause 19, Article 1 of the amended 2012 Law on Lawyers, it stipulates:
- A lawyer practicing independently is a lawyer working under an employment contract for an agency or organization that is not a law practice organization.
- In case the employment contract includes an agreement, the lawyer practicing independently must purchase liability insurance for their practice activities in accordance with legal regulations on insurance business.
- ...
On the other hand, Article 8 of the 2000 Insurance Business Law states that professional liability insurance for legal consulting activities is a mandatory insurance type.
=> Therefore, based on the above provisions, a lawyer practicing independently is required to purchase professional liability insurance. To determine whether you or the business is responsible for purchasing the insurance, you must review the agreement between you and the business in the employment contract.
The above is the support content!
