Pursuant to Clause 8, Article 40 of the Notarization Law 2014, which stipulates the notarization of pre-drafted contracts and transactions, as follows:
- If the person requesting notarization agrees to the entire content of the draft contract or transaction, they must sign on each page of the contract or transaction. The notary public will require the person requesting notarization to present the original documents stipulated in Clause 1 of this Article for verification before recording the notary certificate and signing on each page of the contract or transaction.
Pursuant to Clause 1, Article 48 of the above-mentioned law stipulating signatures and fingerprints in notarized documents, as follows:
- The person requesting notarization, the witness, and the interpreter must sign the contract or transaction in the presence of the notary public.
In the event that the authorized signatory of the credit organization or other enterprise has already registered their signature sample at the notary's office, that person may sign the contract in advance; the notary must compare their signature in the contract with the registered signature sample before notarization.
Pursuant to Article 49 of the Notarization Law 2014, which stipulates the numbering of pages and documents in notarized documents, as follows:
If a notarized document consists of two or more pages, each page must be numbered. If a notarized document consists of two or more sheets, a seal must be affixed across the sheets.
Therefore, when an economic organization participates in signing a land sale contract at a notary's office, the authorized signatory of that economic organization must sign on all pages of the sale contract and do so in the presence of the notary public, unless a signature sample has been registered. The notary's office is responsible for stamping across the sheets of the contract, rather than requiring your company to stamp across the sale contract.
Notarization Time Limit
Pursuant to Article 43 of the above-mentioned law stipulating the notarization time limit, as follows:
The notarization period is calculated from the date of receipt of the notarization request dossier to the date of return of the notarized result. The time spent on verifying, assessing the details related to the contract or transaction, posting the acceptance of the notarization of the document distributing the inheritance, the document acknowledging inheritance, and translating documents is not included in the notarization period.
The notarization period shall not exceed 02 working days; for contracts or transactions with complex content, the notarization period can be extended but shall not exceed 10 working days.
