Correcting Typographical Errors in a Notarized Contract: Is It Allowed? How to Notarize Contract Modifications, Additions, and Cancellations
I have notarized a vehicle sales contract, however, there are typographical errors in the notarized contract. Can I go to the notary office to correct these errors? Please advise.1. Is it possible to correct typographical errors in a notarized contract?
Based on Article 50 of the Notarization Law 2014, the provisions are as follows:
- Technical errors are errors due to mistakes during the recording, typing, and printing in the notarized document, and the correction of these errors does not affect the rights and obligations of the participants in the contract or transaction.
2. The correction of technical errors in notarized documents is performed at the notarial practice organization that has notarized those documents. In the event that the notarial practice organization that performed the notarization ceases its operations, converts, transfers, or dissolves, the notarial practice organization that is preserving the notarial records shall perform the correction of technical errors.
- The notary performing the correction of technical errors shall be responsible for checking each error to be corrected against the documents in the notarial records, underlining the parts to be corrected, then writing the corrected letters, marks, or numbers in the margin, along with their signature and the seal of the notarial practice organization. The notary is responsible for informing the participants in the contract or transaction of the correction.
Thus, according to the above provisions, you can correct typographical errors in a notarized contract at the notary office that notarized this contract previously.
2. How is the notarization of amending, supplementing, and canceling a contract or transaction done?
According to Article 51 of the Notarization Law 2014, the notarization of amending, supplementing, and canceling contracts and transactions is regulated as follows:
The notarization of amending, supplementing, and canceling a notarized contract or transaction is only performed when there is a written agreement and commitment from all parties who participated in the contract or transaction.
The notarization of amending, supplementing, and canceling a notarized contract or transaction is performed at the notarial practice organization that has notarized that particular contract or transaction and is conducted by a notary. In the event that the notarial practice organization that performed the notarization ceases its operations, converts, transfers, or dissolves, the notary of the organization preserving the notarial records shall perform the amending, supplementing, or canceling of the contract or transaction.
The procedure for notarizing the amendment, supplementation, or cancellation of a notarized contract or transaction is carried out in accordance with the procedure for notarizing contracts and transactions as specified in this Chapter.
The procedure for notarizing the amendment, supplementation, or cancellation of contracts or transactions will be conducted according to the above-stated provisions.
