Who issues the Certificate of Passing the Lawyer Apprenticeship Exam?

Based on Clause 2, Article 20 of Circular 10/2021/TT-BTP, the duties and powers of the Chairman of the Examination Council are as follows:

- Responsible for organizing and implementing the duties and powers of the Examination Council as stipulated in Clause 1 of this Article;

- Assign responsibilities to each member of the Examination Council;

- Regulate the duties and powers of the Supporting Committees;

- Responsible for managing, ensuring safety and confidentiality of the exam papers, test results, and other related documents;

- Handle cases of violations of decisions, rules, and regulations of the examination;

- Report to the Chairman of the Vietnam Bar Federation on examination results, financial matters, and be accountable to the Chairman of the Vietnam Bar Federation for organizing the examination and its results;

- Issue the Certificate of Passing the Lawyer Apprenticeship Exam to candidates who meet the examination requirements; revoke the Certificate of Passing the Lawyer Apprenticeship Exam if the exam results are annulled according to the provisions of this Circular;

- Other duties as stipulated in this Circular.

Thus, the Chairman of the Examination Council for the Lawyer Apprenticeship Exam has the authority to issue the Certificate of Passing the Exam to candidates who meet the requirements as stipulated above.

Who is responsible for the content of the exam for the Lawyer Apprenticeship Exam?

Based on Clause 1, Article 21 of Circular 10/2021/TT-BTP, the duties and powers of the Examination Question Committee are as follows:

- Organize the drafting, appraisal, and revision of the exam questions;

- Guide the marking, provide the answer key, and the grading scale for both official and backup exam questions;

- Print and copy the exam questions sufficiently in quantity as required by the Examination Council;

- Package, seal, preserve the exam questions, and hand over the original exam questions and exam papers to the Examination Council;

- Ensure absolute confidentiality and safety for the exam questions, marking guides, answer keys, and grading scale from the start of drafting until the end of the last subject of the examination period.

Members of the Examination Question Committee work independently and directly with the Head of the Examination Question Committee; each member of the Examination Question Committee is individually responsible for the content of the exam questions and ensuring the confidentiality and safety of the exam questions according to their duties and legal regulations on the protection of state secrets.

If the exam question contains errors, members of the Examination Question Committee will be individually responsible for the erroneous content according to the above regulations.
