Can trainee lawyers receive a salary?
At Article 9 of Circular 19/2013/TT-BTP, there are regulations regarding the rights of apprentice lawyers as follows:
- Be guided by the lawyer in updating legal knowledge, skills in participating in litigation, legal consultation skills, skills in representation outside litigation, performing other legal services, management skills, operating a legal practice organization, implementing the Code of Ethics and Professional Conduct for Vietnamese Lawyers, the rights and obligations of the apprentice.
- Assist the guiding lawyer in performing tasks stipulated in Clause 3, Article 14 of the Law on Lawyers, and meanwhile communicate with individuals, agencies, or organizations to exercise rights, obligations, and carry out activities related to defending, representing, protecting the legitimate rights and interests of clients or providing legal consultancy activities.
- Be facilitated by a legal practice organization and the guiding lawyer during the apprenticeship period.
- Request a change of the guiding lawyer in cases stipulated in Article 15 of this Circular.
- Other rights as agreed with the legal practice organization accepting the apprenticeship or as stipulated by law.
=> Therefore, according to the mentioned regulations, whether an apprentice lawyer receives a salary or not depends on the agreement between the apprentice, the guiding lawyer, and the organization where the apprenticeship takes place.
