Can notarized contracts be used as evidence in court?
According to Article 5 of the 2014 Notarization Law, the legal value of notarized documents is stipulated as follows:
- A notarized document takes effect from the date it is signed by a notary public and sealed by the notarization practice organization.
- A notarized contract or transaction is enforceable against the involved parties; in cases where an obligated party fails to fulfill their obligations, the other party has the right to request the Court to resolve the matter according to legal regulations, unless the parties to the contract or transaction have agreed otherwise.
- A notarized contract or transaction has evidentiary value; the facts and events in the notarized contract or transaction are not required to be proven, unless declared null and void by the Court.
- A notarized translation has the same value of use as the original document being translated.
=> Thus, a notarized contract is enforceable with involved parties and has evidentiary value in litigation. You can fully provide the contract used for lending as evidence when filing a lawsuit.
