Can lawyers have tattoos or nose piercings? What forms of practice are allowed for lawyers?
Dear Editorial Board,I have a question that I would like to be resolved. I know a young woman who studies Law and is currently attending a lawyer training course. From my observation, she has a rather strong personality, and most people comment that her appearance does not quite match the typical image of a law student. I am aware that she has quite a few piercings on her body, including a nose piercing. I see that being a lawyer generally involves dressing neatly and formally. I am curious to know whether, according to regulations, lawyers are allowed to have tattoos or nose piercings. Based on Article 3 of Circular 10/2021/TT-BTP regulating the apprenticeship for practicing law:
- Individuals meeting the following conditions are eligible to register for apprenticeship:
a) Vietnamese citizens who are loyal to the Fatherland, adhering to the Constitution and laws, with good moral qualities;
b) Holding a Bachelor's degree in law or a Master's degree in law;
c) Possessing a Certificate of completion of legal training in Vietnam or a Decision recognizing legal training abroad, or documents proving exemption from legal training but required to undergo an apprenticeship as specified in Clause 2, Article 16 of the Lawyer Law.
- Individuals currently undergoing apprenticeship who are found not to meet the conditions stipulated in Clause 1 of this Article must cease their apprenticeship and will not have their apprenticeship period recognized. Those who have completed the apprenticeship period and are found not to meet the conditions stipulated in Clause 1 of this Article will not have their apprenticeship period recognized.
Thus, having tattoos or piercings is not a criterion for assessing a person’s eligibility to practice law or even become a lawyer. Currently, there are no documents regulating tattoos or piercings during legal training. Therefore, if the woman you know has tattoos or nose piercings, she can still become a lawyer.
In What Forms Can Lawyers Practice?
According to Article 23 of the Lawyer Law 2006, as amended by Clause 13, Article 1 of the Amended Lawyer Law 2012, the forms of practice for lawyers are regulated as follows:
Lawyers can choose one of the following forms of practice:
Practice within a legal practice organization by establishing or participating in the establishment of a legal practice organization; working under a labor contract for a legal practice organization;
Practice individually as stipulated in Article 49 of this Law.
Therefore, according to the above regulations, lawyers can practice within a legal practice organization or individually.
