I am currently an intern in the practice of notary, but I plan to move to another province. Can I change my internship place?

Based on Clause 1, Article 4 of Circular 04/2015/TT-BTP, interns are allowed to change their place of internship for the practice of notary in the following cases:

a) The notary office that accepts the intern suspends, terminates, converts, or dissolves its operations in accordance with the provisions of the Law on Notaries and implementing documents;

b) The notary office that accepts the intern no longer meets the conditions for accepting interns as prescribed in Clause 2, Article 11 of the Law on Notaries;

c) The notary who guides the intern dies, is unable to continue guiding the intern due to health reasons or other objective reasons, or the notary who guides the intern does not fully fulfill the responsibilities prescribed in Article 10 of this Circular and the notary office does not have another notary who is qualified to guide the intern;

d) The intern changes their place of residence to another province or central-affiliated city.

According to the above regulations, if you change your place of residence to another province, you are allowed to change your place of internship for the practice of notary.

What are procedures for changing the place of internship for the practice of notary when changing residence in Vietnam?

According to Clauses 2 and 3 of this Article, the procedure for changing the place of residence to change the place of internship for the practice of notary is as follows:

2. In case the intern changes the place of internship to another notary office in the same province or central-affiliated city, they shall submit a written request for change of place of internship to the Department of Justice where they registered for internship. The request must clearly state the reason for changing the place of internship, with confirmation from the notary office that accepts the intern on the time and the fulfillment of the rights and obligations of the intern at the organization and confirmation from the notary office that the intern wants to transfer to about receiving the intern.

Within 05 working days, from the date of receipt of the intern's request, the Department of Justice shall notify in writing the intern, the notary office that accepts the intern, and the notary office that the intern wants to transfer to about the change of place of internship; in case of refusal, it must be notified in writing with clear reasons.

3. In case the intern changes the place of internship to a notary office in another province or central-affiliated city, they shall submit a written request for change of place of internship to the Department of Justice where they registered for internship. The request must clearly state the reason for changing the place of internship, with confirmation from the notary office that accepts the intern on the time, the number of times of temporary suspension of internship (if any), and the fulfillment of the rights and obligations of the intern at the organization.

Within 05 working days, from the date of receipt of the intern's request, the Department of Justice shall notify in writing the notary office that accepts the intern and the intern about withdrawing the name of the intern from the List of interns of the Department of Justice, and at the same time confirming the time of internship, the place of internship, and the number of times of temporary suspension of internship (if any) of the intern at the local place; in case of refusal, it must be notified in writing with clear reasons. The intern registers for internship at the Department of Justice where the notary office they are transferring to is located according to the provisions of Article 2 of this Circular to continue their internship; the internship registration dossier must be accompanied by a written notification from the Department of Justice where the intern had registered for internship before according to this clause.
