Can a Bailiff's Office be Transferred?
According to Clause 1, Article 28 of Decree 08/2020/ND-CP on the transfer of the Bailiff Office as follows:
- The Bailiff Office may be transferred to other bailiffs who meet the conditions specified in Clause 2 of this Article. The Bailiff Office can only be transferred after it has been in operation for at least 02 years from the date of issuance of the Operating Registration Certificate.
- Bailiffs who have transferred their Bailiff Office are not allowed to establish or participate in the establishment of a new Bailiff Office within 05 years from the date of transfer but are allowed to practice as a bailiff under employment contract policies.
=> Therefore, your case does not meet the conditions for transfer. To be able to transfer the Bailiff Office, the office must have been in operation for at least 02 years.
