Application for Criminal Record Certificate for Foreigners Who Have Resided Temporarily in Vietnam: Where to Apply?
Article 7, Clause 1 of the 2009 Law on Judicial Records stipulates:
Vietnamese citizens and foreigners who have resided or are residing in Vietnam have the right to request the issuance of their Judicial Record Certificates.
Thus, foreigners who have resided in Vietnam have the right to request the issuance of their Judicial Record Certificate.
According to the 2006 Law on Residence, a place of residence includes both permanent and temporary residence.
Therefore, foreigners who have temporarily resided in Vietnam can also apply for a Judicial Record Certificate in Vietnam.
Point b, Clause 2, Article 45 of the 2009 Law on Judicial Records also stipulates the procedure for requesting Judicial Record Certificate No. 1 as follows:
Foreigners residing in Vietnam shall submit their requests to the Department of Justice where they reside; in cases where they have left Vietnam, they shall submit their requests to the National Judicial Records Center.
Thus, in this case, foreigners can apply for Judicial Record Certificate No. 1 at the National Judicial Records Center.
