What types of contracts are included in a PPP project?
According to Clause 16, Article 3 of the Law on Investment in the Form of Public-Private Partnership 2020 (effective from January 01, 2021), a PPP project contract is a written agreement between the contracting authority and the investor, PPP project enterprise regarding the State's concession to the investor, PPP project enterprise to implement the PPP project in accordance with the provisions of the Law on Investment in the Form of Public-Private Partnership.
To be specific, it includes the following types of contracts:
- Build - Operate - Transfer contract (BOT);
- Build - Transfer - Operate contract (BTO);
- Build - Own - Operate contract (BOO);
- Operate - Manage contract (O&M);
- Build - Transfer - Lease contract (BTL);
- Build - Lease - Transfer contract (BLT);
- Hybrid contracts as specified in Clause 3, Article 45 of this Law.
