Is it possible to adjust the approved construction design in Vietnam?
Based on Article 84 of the Construction Law 2014 on adjustments of construction designs:
Article 84. Adjustment of Construction Designs
- Approved construction designs can only be adjusted in the following cases:
a) When adjusting the construction investment project requires an adjustment of the construction design;
b) During construction, there is a requirement to adjust the construction design to ensure the quality of the works and the effectiveness of the project.
- When adjustments to the construction design are made according to Clause 1 of this Article that change the geological structure, design load, structural solutions, materials of the load-bearing structures, or construction organization methods affecting the structural safety of the works, such adjustments must be appraised and approved pursuant to Article 82 of this Law.
According to the above regulation, approved construction designs can only be adjusted in the following cases:
- When adjusting the construction investment project requires an adjustment of the construction design
- During construction, there is a requirement to adjust the construction design to ensure the quality of the works and the effectiveness of the project
What are the rights and obligations of the investor in construction design in Vietnam?
Based on Article 85 of the Construction Law 2014 (amended by Clause 27, Article 1 of the Amended Construction Law 2020) stipulating the rights and obligations of the investor in construction design:
Article 85. Rights and Obligations of the Investor in Construction Design
- The investor has the following rights:
a) To self-perform the design, verify construction designs when having sufficient capacity for construction activities, occupational competence suitable for the type and grade of construction works;
b) To select the design contractor, verify construction designs in case of not self-performing the design and verification of construction designs;
c) To negotiate and sign contracts for construction design, verify construction designs, supervise and require the contractor to strictly follow the signed contract, suspend, or terminate the contract as prescribed in the contract and relevant laws;
d) Other rights prescribed by the contract and relevant laws.

The investor has the following rights and obligations in construction design:

- To select the design contractor, verify construction designs in case of not self-performing the design and verification of construction designs
- To negotiate and sign contracts for construction design, verify construction designs, supervise, and require the contractor to strictly follow the signed contract, suspend, or terminate the contract as prescribed in the contract and relevant laws
- Other rights prescribed by the contract and relevant laws
[2] The investor has the following obligations:
- To select the design contractor, verify construction designs that have sufficient capacity for construction activities, occupational competence suitable for the type and grade of construction works
- To determine the tasks for construction design
- To provide sufficient information and documents to the design contractor, verify construction designs
- To strictly implement the signed contract; compensate for damages when violating the signed construction design contract
- To appraise, approve construction designs as prescribed
- To take responsibility before the law and the person making the investment decision for the results of the work performed
- To archive construction design documents
- Other obligations prescribed by the contract and relevant laws.
