What is Golf Course?
Clause 1, Article 2 of Decree 52/2020/ND-CP (Effective from June 15, 2020) stipulates as follows:
A golf course is a construction project that includes a golf course and auxiliary works, designed on an appropriate scale and with technical standards to serve golfers.
In this Decree, there are 3 principles for the investment, construction, and business operation of golf courses which are:
- The investment, construction, and business operation of golf courses aim to promote socio-economic development, services, tourism, and sports; to meet the diverse needs of recreational activities, and to enhance physical fitness and public health.
- The implementation of golf course projects must not impact national defense, security, social order, social safety, social ethics, public health, the environment, natural resources, historical-cultural heritage, and scenic spots that have been recognized and protected by competent state agencies according to the provisions of the law; ensuring the rights, legal interests, and social welfare of people whose land is recovered for golf course construction.
- The land used for golf course construction must be in accordance with land use planning and plans; ensuring proper, economical, and effective use; meeting the conditions and procedures prescribed in this Decree, and the laws on investment, planning, land, construction, environment, and related laws.
