Issuance of Circular regulating instructions for uploading information about contractor selection on the National Public Procurement System in Vietnam

On February 15, 2024, the Minister of Planning and Investment issued Circular 01/2024/TT-BKHDT providing guidance on the provision and publication of information on contractor selection and tender documents on the National Public Procurement System.

Accordingly, the information about the capacity and experience of contractors on the System includes:

+ General information about the contractor.

+ Annual financial reports.

+ Information about ongoing and completed contracts.

+ Key personnel information.

+ Information about machinery and equipment.

+ Information about the reputation of the contractor.

Contractors are responsible for actively updating their capacity and experience information on the System and ensuring the accuracy of the declared information in accordance with the law.

In cases where contractors make changes on the System, the System will retain both the previous and updated information. The capacity and experience information of the contractor is verified using the digital signature of the contractor.

- Contractors must attach documents and materials to prove the authenticity of their capacity and experience. The attached documents and materials are stored and managed on the System.

- If contractors provide false information to gain financial or other benefits or to evade any obligations, it will be considered as fraudulent behavior.

- Regarding the financial report data, if the financial report data on the System has already been updated from the Electronic Tax System and the National Business Registration Information System, the contractor does not need to declare the financial report data.

For financial report data from 2021 onwards, if contractors discover that the System has not updated the data compared to the Electronic Tax System, they should make corrections to align with the reported data to the tax authority. The System will retain the revised versions of the contractor's information.

When publishing a project and contractor selection plan, what documents must be attached by the investors in Vietnam?

Under Article 11 of Circular 01/2024/TT-BKHDT, there are provisions regarding information about the project and contractor selection plan as follows:

Information about the project and contractor selection plan:

1. Posting period:

Information about the contractor selection plan must be posted on the System within 5 working days from the date of approval of the contractor selection plan. Basic information about the project should be posted simultaneously with the contractor selection plan.

2. Attached documents:

The investor must attach the decision approving the contractor selection plan during the posting of the contractor selection plan.
