What are the main contents of the contractor selection master plan for projects in Vietnam?
Based on Article 36 of the Bidding Law 2023, the contractor selection master plan for projects is regulated as follows:
Article 36. Contractor selection master plan for projects
1. Based on the scale and nature of the bidding activities of the project, the investor or project preparation agency can submit to the competent authority for consideration and decision on organizing, approving the master plan for contractor selection.
2. The master plan for contractor selection is prepared simultaneously or independently with the feasibility study report and is approved after the feasibility study report is approved.
3. The master plan for contractor selection includes the following main contents:
a) Reviewing the project's implementation context in terms of bidding activities;
b) Assessing the capabilities, resources, and experience of the investor in carrying out the project's bidding activities;
c) Analyzing the market and identifying risks in bidding;
d) Specific objectives of the bidding activities;
dd) Proposing the master plan for contractor selection for the project, including: dividing the project into bidding packages; forms and methods of contractor selection; types of contracts, principles for risk division and management; timetable for main tasks, bidding packages; other noteworthy contents in preparing bidding documents, managing contract implementation.
4. The Government of Vietnam shall detail this Article.

- Reviewing the project's implementation context in terms of bidding activities
- Assessing the capabilities, resources, and experience of the investor in carrying out the project's bidding activities
- Analyzing the market and identifying risks in bidding
- Specific objectives of the bidding activities
- Proposing the master plan for contractor selection for the project, including:
+ Dividing the project into bidding packages
+ Forms and methods of contractor selection
+ Types of contracts, principles for risk division and management
+ Timetable for main tasks, bidding packages
+ Other noteworthy contents in preparing bidding documents, managing contract implementation.
What are rules for preparing contractor selection plan in Vietnam?
Based on Article 37 of the Bidding Law 2023 on the rules for preparing contractor selection plan
- The contractor selection plan is prepared for the entire project or procurement estimate. For procurement estimates, the contractor selection plan can be prepared based on the annual budget estimate and the projected budget estimates for the following years.
- If the conditions for preparing a contractor selection plan for the entire project or procurement estimate are not met, a contractor selection plan is prepared for one or several packages to be executed first.
- If a package has an execution period longer than 01 year, the contractor selection plan must clearly state the execution period of the package and the package price based on the entire execution period of the package.
- The contractor selection plan must clearly indicate the number of packages and the content of each package.
- The approval of the contractor selection plan must be based on technical characteristics, order of execution; ensuring the project's or procurement estimate's synchronization and compatibility with the approved master plan for contractor selection (if any).
- The contractor selection plan is prepared after the procurement estimate, project approval decision, or simultaneously with the project preparation, procurement estimate, or before the project approval decision for packages that need to be executed before the project approval decision.
