On October 5, 2024, the Government of Vietnam issued Decree 125/2024/ND-CP regulating requirements for educational investment and business operation in Vietnam:
- Establishment or permit for establishment, permit for educational activities, suspension of educational activities, merger, division, separation, dissolution of: Preschool education institutions, general education institutions, specialized schools
- Establishment or permit for establishment, suspension of operations, merger, division, separation, dissolution of: Continuing education institutions, centers supporting inclusive education development
- Establishment or permit for establishment of teacher training colleges; issuance of registration certificates for vocational education operations for groups of college-level teacher training sectors; suspension of vocational education operations for these sectors; revocation of registration certificates for vocational education operations in these sectors; merger, division, separation, dissolution of teacher training colleges; merging colleges into universities
- Establishment or permit for establishment of universities, branches of higher education institutions; allow universities, branches of higher education institutions to operate; suspension of operations of higher education institutions, branches of higher education institutions, merger, division, separation of higher education institutions; dissolution of higher education institutions, branches of higher education institutions; recognition of regional universities, national universities
- Establishment or permit for establishment, permission to operate, suspension of operations, dissolution of Vietnam’s educational quality accreditation organizations; recognition of foreign educational quality accreditation organizations operating in Vietnam
- Business registration for overseas study consultancy services; suspension of overseas study consultancy services; revocation of business registration certificates for overseas study consultancy services.
Decree 125/2024/ND-CP takes effect in Vietnam from November 20, 2024.

What does application for approval of educational business operation of preschool in Vietnam?
According to Article 6 of Decree 125/2024/ND-CP, the procedures for approval of educational business operation of preschool in Vietnam are specified as follows:
Article 6. Procedures for approval of educational business operation of preschool in Vietnam
1. The Head of the Department of Education and Training decides whether to permit the operation of preschool education.
2. The application includes:
a) A proposal for permission for the preschool to operate (according to Form No. 03 Appendix 1 attached to this Decree);
b) Copies of legal documents proving the right to use the land, ownership of the buildings, or lease contracts for the preschool site with a minimum term of 5 years;

- For private preschools, legal documents confirming the amount of investment managed by the school, ensuring legality and suitability with the anticipated scale at the time of educational operation registration
- The school's organization and operation regulation include the following main contents:

+ Organization and management of the school
+ Organization of nurturing, caring for, and educating children
+ Duties and rights of management staff, teachers, staff, employees, and children
+ Finance and assets of the school
+ Other issues related to the organization and operation of the school
What levels of education does the national education system in Vietnam comprise?
According to Article 6 of the Education Law 2019, the national education system is structured as follows:
Article 6. The national education system
1. The national education system is an open, continuous system comprising formal education and continuing education.
2. The levels of education, training levels of the national education system include:
a) Preschool education includes nursery education and kindergarten education;
b) General education includes primary education, lower secondary education, and upper secondary education;
c) Vocational education provides training at elementary, intermediate, and college levels, as well as other vocational training programs;
d) Higher education provides undergraduate, master’s, and doctoral levels.
3. The Prime Minister of the Government of Vietnam decides to approve the framework of the national education system structure and the Vietnamese national qualification framework; specifies training duration, standards for each training level, the minimum learning volume for vocational and higher education.
4. The Minister of Education and Training, Minister of Labor, Invalids and Social Affairs, within their duties and powers, stipulate the admission thresholds for teacher training at college and university level, and fields related to healthcare.
Thus, the national education system comprises preschool education, general education, vocational education, and higher education.
