What are conditions to apply for a license to produce and retail spirits having less than 5.5% alcohol by volume (ABV) in Vietnam?

Pursuant to Article 9 of Decree 105/2017/ND-CP regulating requirements for home production of alcohol for business purposes as follows:

1. The enterprise, cooperative, cooperative joint venture or household business producing alcohol at home shall be established according to regulations of law.

2. Food safety and labeling of alcohol shall be ensured.

And the alcohol retail conditions in Article 13 of Decree 105/2017/ND-CP are abolished by Clause 5, Article 17 of Decree 17/2020/ND-CP stipulating requirements for retailing of alcohol as follows:

1. The enterprise, cooperative, cooperative joint venture or household business retailing alcohol (alcohol retailer) shall be established according to regulations of law.

2. The alcohol retailer shall be entitled to run a fixed store with a clear address.

3. A written reference or an agreement in principle shall be made by the alcohol producer, distributor or wholesaler.

In addition, it also meets the conditions for producing wine and selling spirits having less than 5.5% ABV according to Article 31a and Article 31c of Decree 17/2020/ND-CP as follows:

Article 31a. Conditions for production of spirits having less than 5.5% ABV

1. Be an enterprise, cooperative, cooperative union or household business that is established in accordance with the law.

2. Comply with regulations of the law on food safety.

3. Register its production with the Office of Economics or Office of Economics and Infrastructure affiliated to the People’s Committee of the district where the trader’s production facility is located using the Form No. 14 Section II in the Appendix hereof. In case of change of the registered contents, it is required to register additional contents.

Article 31c. Conditions for sale of spirits having less than 5.5% ABV

1. Satisfy the conditions set forth in Clauses 1 and 2 Article 31a of this Decree.

2. Register its sale with the Office of Economics or Office of Economics and Infrastructure affiliated to the People’s Committee of the district where the seller is located before doing business using the Form No. 14 Section II in the Appendix hereof. In case of change of the registered contents, it is required to register additional contents.

What are applications for licenses for home production of alcohol for business purposes in Vietnam?

Pursuant to Article 20 of Decree 105/2017/ND-CP amended by Clause 15, Article 16 of Decree 17/2020/ND-CP stipulating applications for licenses for home production of alcohol for business purposes as follows:

A set of application for the license for home production of alcohol for business purposes shall consist of:

1. A completed application form provided in the specimen No. 1 attached hereto.

2. A copy of the certificate of enterprise/cooperative/cooperative joint venture/household business registration.

3. A copy of the Spirit Declaration or the Certificate of submission of Declaration of Conformity or the Certificate of Declaration of conformity with the food safety regulations (if the spirit is not regulated by a technical regulation); a copy of the Certificate of food safety, except for small scale food trading establishments prescribed by the Law on Food Safety.

4. A manifest of alcoholic drinks and a copy of alcoholic drink labels that the enterprise has produced or intends to produce.
