Who are the members of the bidding expert team?
Article 19 of the Law on Bidding 2023 stipulates the expert team and the appraisal team as follows:
Expert Team, Appraisal Team
1. The expert team consists of individuals with competence and experience, appointed or assigned tasks by the investor or the bidding consultancy unit for contractor selection, or by the inviting party for investor selection, to perform one or more tasks: preparing prequalification invitation documents, prequalification records, bidding documents, requirement documents; evaluating expressions of interest, prequalification records, bid proposals, business investment project proposals; performing other tasks during the contractor or investor selection process.
The appraisal team consists of individuals with competence and experience, appointed or assigned tasks by the authorized person, investor, or the bidding consultancy unit to review and consider the compliance with legal regulations regarding one or more of the following contents: the overall plan for contractor selection, contractor selection plans; prequalification invitation documents, prequalification records, bidding documents, requirement documents, and the results of prequalification, bidding, and investor selection.
Members of the expert team and the appraisal team must have at least 3 years of experience in one of the areas related to the legal, technical, or financial aspects of the bidding package or business investment project.
The Government of Vietnam stipulates in detail the competence and experience of the members of the expert team and the appraisal team.
Thus, the bidding expert team consists of individuals with competence and experience appointed or assigned tasks by the investor or the bidding consultancy unit for contractor selection, or by the inviting party for investor selection, to perform one or more of the following tasks:
- Preparing prequalification invitation documents, prequalification records, bidding documents, requirement documents;
- Evaluating expressions of interest, prequalification records, bid proposals, business investment project proposals;
- Performing other tasks during the contractor or investor selection process.
What are the responsibilities of the expert team?
Article 80 of the Law on Bidding 2023 stipulates the responsibilities of the bidding expert team as follows:
Responsibilities of the Expert Team
Preparing prequalification invitation documents, prequalification records, bidding documents, requirement documents.
Evaluating expressions of interest, prequalification records, project registration documents for business investment, bid proposals, proposals; proposing solutions to the inviting party in case of arising situations in bidding (if any).
Ensuring the confidentiality of information and documents related to the contractor or investor selection process.
Providing information, related documents, and explanations on the performance of the responsibilities stipulated in this Article upon the request of the authorized person, investor, inviting party, inspection authorities, or state management agencies overseeing bidding activities.
Performing other responsibilities as stipulated by this Law and other related legal regulations.
Thus, the bidding expert team has the following responsibilities:
- Preparing prequalification invitation documents, prequalification records, bidding documents, requirement documents.
- Evaluating expressions of interest, prequalification records, project registration documents for business investment, bid proposals, proposals; proposing solutions to the inviting party in case of arising situations in bidding (if any).
- Ensuring the confidentiality of information and documents related to the contractor or investor selection process.
- Providing information, related documents, and explanations on the performance of the responsibilities stipulated in Article 80 of the Law on Bidding 2023 upon the request of the authorized person, investor, inviting party, inspection authorities, or state management agencies overseeing bidding activities.
- Performing other responsibilities as stipulated by the Law on Bidding 2023 and other related legal regulations.
