What are the main contents of the comprehensive contractor selection plan?
Based on Article 36 of the Law on Bidding 2023, which regulates the comprehensive contractor selection plan for a project:
Article 36. Comprehensive contractor selection plan for a project
- Based on the scale and nature of the project's bidding work, the investor or the project preparation agency may submit to the competent authorities for consideration and decision on the organization, establishment, and approval of the comprehensive contractor selection plan.
- The comprehensive contractor selection plan is prepared concurrently or independently with the feasibility study report and is approved after the feasibility study report is approved.
- The comprehensive contractor selection plan includes the following main contents:
a) Consideration of the project's implementation context concerning the bidding work;
b) Assessment of the investor's capacity, resources, and experience regarding the implementation of the project's bidding activities;
c) Market analysis and risk identification in bidding;
d) Specific objectives of the bidding activities;
e) Proposal for the comprehensive contractor selection plan for the project, including: dividing the project into packages; forms and methods of selecting contractors; type of contract, principles of division and risk management; schedule for major tasks and packages; other contents to note in drafting bidding documents and contract management.
- The Government of Vietnam stipulates the details of this Article.
Thus, the comprehensive contractor selection plan includes the following main contents:
- Consideration of the project's implementation context concerning the bidding work
- Assessment of the investor's capacity, resources, and experience regarding the implementation of the project's bidding activities
- Market analysis and risk identification in bidding
- Specific objectives of the bidding activities
- Proposal for the comprehensive contractor selection plan for the project, including:
+ Dividing the project into packages
+ Forms and methods of selecting contractors
+ Type of contract, principles of division and risk management
+ Schedule for major tasks and packages
+ Other contents to note in drafting bidding documents and contract management
On what basis is the contractor selection plan established?
Based on Article 38 of the Law on Bidding 2023, which stipulates the establishment of the contractor selection plan:
Article 38. Establishment of the contractor selection plan
- The basis for establishing the contractor selection plan for projects:
a) The project approval decision and related documents, except for packages that need to be implemented before the project approval. For packages that need to be implemented before the project approval, base on the decision of the head of the investor or the head of the unit assigned to prepare the project if the investor has not been identified;
b) The comprehensive contractor selection plan (if any);
c) The project has been assigned a medium-term public investment plan, except for emergency public investment projects according to the provisions of public investment law;
d) The capital arrangement plan for the project or the source of funding for the project for those not covered under the medium-term public investment plan, except for emergency public investment projects according to the provisions of public investment law;
