Regulations on the Order and Procedures for Land Allocation and Land Lease for Investors Winning Bids for Investment Projects Utilizing Land
According to Clause 2, Article 60 of Decree 25/2020/ND-CP (effective from April 20, 2020), the procedures for land allocation and land lease, as well as the determination of land levy and land rent for investors who win the bid, are stipulated as follows:
- After completing the compensation, support, and resettlement for the land area where the project is implemented, the allocation and leasing of land to investors shall follow the procedures stated in Clause 3, Article 68 of Decree No. 43/2014/ND-CP dated May 15, 2014, of the Government of Vietnam, detailing the implementation of several articles of the Land Law No. 45/2013/QH13 and any amendments, supplements, or replacements (if any).
- The provincial land management authority shall organize the determination of land levy and land rent and report to the Land Price Appraisal Council for review before submission to the Provincial People's Committee for approval of the land levy and land rent that the investor must pay at the time the State decides to allocate or lease the land, in accordance with land law regulations.
