Regulations on Establishing the List of Land-Use Investment Projects
The preparation of the list of land-use investment projects is specifically stipulated in Clause 2, Article 12 of Decree No. 25/2020/ND-CP (effective from April 20, 2020), accordingly:
- In cases where the project is prepared by specialized agencies under the Provincial People's Committee or the District People's Committee:
The specialized agencies under the Provincial People's Committee or the District People's Committee shall prepare a proposal for a land-use investment project and send it to the Department of Planning and Investment for summarization. The proposal content includes: Project name, investment objectives, investment scale, preliminary total project implementation costs, investment capital, capital mobilization plan, location, duration, investment progress, socio-economic efficiency analysis of the project, and preliminary requirements on the capability and experience of the investors.
- In cases where the project is proposed by the investor:
The investor is allowed to propose the implementation of a land-use investment project outside the list of land-use investment projects approved by the Chairman of the Provincial People's Committee. The project proposed by the investor must fall within the scope of regulation specified in point b, clause 1, Article 1 of this Decree and meet the conditions mentioned in Article 11 of this Decree. The investor shall prepare a project proposal dossier and send it to the Department of Planning and Investment for summarization. The project proposal dossier includes the following contents:
+ A document requesting the implementation of a land-use investment project, including a commitment to bear all costs and risks if the project proposal dossier is not accepted;
+ The project proposal content includes: Project name, investment objectives, investment scale, preliminary total project implementation costs, investment capital, capital mobilization plan, location, duration, investment progress; socio-economic efficiency analysis of the project;
+ Dossiers on the legal status, capability, and experience of the investor;
+ Proposal on land use demand;
+ Other necessary documents to clarify the project proposal dossier (if any).
