Procedure for Selecting Contractors in Construction Activities for Projects Using Public Investment Funds within the People's Court System
Pursuant to Article 14 of the Regulation on Certain Contents of Investment Construction Project Management Using Public Investment Funds within the People's Court System, issued in conjunction with Decision 608/QD-TANDTC-KHTC in 2021 by the Chief Justice of the Supreme People's Court, the procedure for selecting contractors in construction activities is stipulated as follows:
- Preparing, Appraising, and Approving the Contractor Selection Plan
a) Based on the approved total estimate, the investor organizes the preparation of the contractor selection plan in accordance with the Law on Bidding and related legal documents, and submits it to the Investment Decision Maker for approval.
b) The division of the project into bidding packages must be based on technical characteristics and implementation sequence; ensure project synchronization and reasonable package scale. It is strictly prohibited to divide packages with the intent of direct appointment or to limit the participation of contractors.
c) The Investment Decision Maker organizes the appraisal and approval of the contractor selection plan, except for the contractor selection plan in the investment preparation stage.
- Organizing Contractor Selection
a) Based on the approved contractor selection plan, the investor organizes the selection of contractors according to the contents specified in the contractor selection plan, including: Name of the package; Package price; Source of capital; Form of contractor selection; Method of contractor selection; Time to start organizing contractor selection; Type of contract; Contract implementation time.
b) Any changes or adjustments to the contents in the contractor selection plan must be approved by the Investment Decision Maker, except for the package price content specified in Clause 2, Article 117, Decree 63/2014/ND-CP.
Authorization to Approve the Contractor Selection Plan for Non-decentralized Projects Using Public Investment Funds within the People's Court System
According to Article 15 of the Regulation on Certain Contents of Investment Construction Project Management Using Public Investment Funds within the People's Court System, issued in conjunction with Decision 608/QD-TANDTC-KHTC in 2021 by the Chief Justice of the Supreme People's Court regarding the authorization to approve the contractor selection plan for non-decentralized projects as follows:
The Chief Justice of the Supreme People's Court authorizes the Chief Justices of the Provincial People's Courts to approve, approve adjustments, and supplement the contractor selection plan for the packages that serve for the design implementation after the basic design.
