Procedure for Reissuance of the Construction Valuation Practice Certificate
Legal Basis: - Construction Law 2014; Decree 15/2021/ND-CP; Decree 100/2018/ND-CP; Circular 38/2022/TT-BTC; Amended Construction Law 2020.
According to current legal regulations, construction cost estimation practicing certificates are classified as follows: Class I Construction Cost Estimation Practicing Certificate, Class II Construction Cost Estimation Practicing Certificate, and Class III Construction Cost Estimation Practicing Certificate.
Individuals who have been issued a Construction Cost Estimation Practicing Certificate can have it reissued according to legal regulations.
The process and procedures for reissuing the Construction Cost Estimation Practicing Certificate are specifically as follows:
1. Conditions for reissuance:
An individual can have the Construction Cost Estimation Practicing Certificate reissued if:
- The old certificate is lost;
- The old certificate is damaged;
- The old certificate has expired.
2. Dossier for reissuance:
Includes:
- An application form for the Construction Cost Estimation Practicing Certificate;
- A certified copy or a file containing a color photo taken from the original or a copy, presenting the original for comparison of the issued Construction Cost Estimation Practicing Certificate. In case of loss of the certificate, a commitment from the applicant for reissuance must be provided.
- 02 color photos size 4 x 6 cm with a white background taken within the last 06 months.
3. Reissuance process:
- Individuals submit 01 set of documents requesting reissuance of the Construction Cost Estimation Practicing Certificate online, by post, or directly at the competent authority for issuing the Construction Cost Estimation Practicing Certificate.
- Within 10 days from the date of receipt of a complete and valid dossier, the competent authority is responsible for issuing the Construction Cost Estimation Practicing Certificate.
Note: In case the dossier is incomplete or invalid, the competent authority must notify the individual requesting reissuance in writing one time within 05 days from the date of receipt of the dossier requesting reissuance.
4. Competence for reissuance:
- Class I: Specialized construction agency under the Ministry of Construction.
- Class II, Class III: Department of Construction; Or a recognized social-professional organization that is qualified to issue construction practice certificates to their members.
5. Resolution timeframe: 10 days from the date of receipt of a complete and valid dossier.
6. Reissuance fee: 150,000 (One hundred and fifty thousand) VND per certificate.
7. Validity of the certificate: is the remaining validity of the old certificate in case of reissuance due to loss or damage, 05 years in case of reissuance due to expiration.
Note: For the practice certificate of foreign individuals, the validity is determined according to the validity period stated in the labor permit or temporary residence card issued by the competent authority but not exceeding 05 years.
