Procedure for Reissuance of the Construction Survey Practice Certificate
Legal Basis: - Construction Law 2014; Decree 15/2021/ND-CP; Decree 100/2018/ND-CP; Circular 38/2022/TT-BTC; Amended Construction Law 2020.
According to current legal regulations, the Construction Surveying Practice Certificate is classified into the following categories: Class I Construction Surveying Practice Certificate, Class II Construction Surveying Practice Certificate, and Class III Construction Surveying Practice Certificate.
Individuals who have been issued a Construction Surveying Practice Certificate can have it reissued in accordance with the law.
Procedure for reissuing the Construction Surveying Practice Certificate is specifically implemented as follows:
1. Conditions for reissuance:
An individual is eligible for reissuance of the Construction Surveying Practice Certificate when:
- The old certificate is lost and still valid;- The old certificate is damaged and still valid;- The old certificate has expired.
2. Dossier for reissuance of the Construction Surveying Practice Certificate
The dossier for reissuance includes:
- Application form for the Construction Surveying Practice Certificate;- Certified copy or file containing color photos taken from the original or a copy, presenting the original for comparison of the previously issued Construction Surveying Practice Certificate. In case the certificate is lost, a commitment from the applicant is required.- 02 color photos, 4 x 6 cm size, with a white background, taken within the last 06 months.
3. Reissuance process:
- Individuals submit 01 dossier for reissuance of the Construction Surveying Practice Certificate online, by post, or directly at the competent authority issuing the certificate.- Within 10 days from the date of receipt of a complete and valid dossier, the competent authority is responsible for issuing the Construction Surveying Practice Certificate.
Note: In case the dossier is incomplete or invalid, the competent authority must notify the individual requesting reissuance in writing within 05 days from the receipt of the application.
4. Authority for reissuance:
- Class I: Specialized construction departments under the Ministry of Construction.
- Class II, Class III: Department of Construction; or recognized professional organizations eligible to issue Construction Surveying Practice Certificates to their members.
5. Processing time: 10 days from the date of receipt of a complete and valid dossier.
6. Reissuance fee: 150,000 (One hundred and fifty thousand) VND per certificate.
7. Validity of the Certificate: equivalent to the remaining term of the old certificate in case of loss or damage; 05 years in case of reissuance due to expiration.
Note: For foreign individuals' practice certificates, validity is determined by the term specified in the work permit or temporary residence card issued by the competent authority but does not exceed 05 years.
