Procedure for Re-issuance of Supervision of Construction Execution Practice Certificate

*Legal Basis:- Law on Construction 2014;- Decree 15/2021/ND-CP;- Decree 100/2018/ND-CP;- Circular 38/2022/TT-BTC;- Amended Law on Construction 2020.

According to current laws, the Certification for construction supervision practice is divided into the following categories: Category I Certification for construction supervision practice, Category II Certification for construction supervision practice, and Category III Certification for construction supervision practice.

An individual who has been issued a Certification for construction supervision practice may be reissued the certification according to legal provisions.

Procedure for Reissuing the Certification for Construction Supervision Practice is as follows:

1. Conditions for Reissuing:

An individual may have their Certification for construction supervision practice reissued if:

- The original certification is lost;- The original certification is damaged;- The original certification has expired.

2. Reissuance Dossier:

Includes:

- Application for reissuing the Certification for construction supervision practice;- Certified copy or file containing a color photograph taken from the original or copy to be presented with the original for comparison of the previously issued Certification for construction supervision practice. If the certification is lost, the applicant must provide a commitment declaration.- 02 color photographs sized 4 x 6 cm with a white background taken within the last 06 months.

3. Reissuance Process:

- The individual submits 01 set of dossier for reissuing the Certification for construction supervision practice via the online network, postal mail, or directly to the competent authority that issues the Certification for construction supervision practice.- Within 10 days from the date of receipt of a valid dossier, the competent authority is responsible for issuing the Certification for construction supervision practice.

Note:In the case of an incomplete or invalid dossier, the competent authority must notify the individual applying for reissuance of the Certification for construction supervision practice once in writing within 05 days from the date of receipt of the dossier application.

4. Authority for Reissuance:

- Category I: Specialized construction agency under the Ministry of Construction.

- Category II, Category III: Department of Construction; or recognized social-professional organization deemed qualified to issue Construction Practice Certificates to their members.

5. Resolution Time: 10 days from the date of receipt of a valid dossier.

6. Reissuance Fee: 150,000 VND (One hundred fifty thousand dong)/certificate.

7. Validity of the Certificate: Remaining validity of the old certificate in cases of loss or damage; 05 years in cases of reissuance due to expiration.

Note:For certifications of foreign individuals, the validity is determined according to the duration specified in the work permit or temporary resident card issued by the competent authority but not exceeding 05 years.
