Procedure for Re-Issuance of Practicing Certificate for Construction Project Design
Legal Basis:- The Construction Law 2014;- Decree 15/2021/ND-CP;- Decree 100/2018/ND-CP;- Circular 38/2022/TT-BTC;- The amended Construction Law 2020.
According to current legal regulations, the Professional Certificate for Construction Design is categorized as follows: Level I Professional Certificate for Construction Design, Level II Professional Certificate for Construction Design, and Level III Professional Certificate for Construction Design.
Individuals who have been granted the Professional Certificate for Construction Design may be re-issued the said Professional Certificate according to legal regulations.
The procedure for re-issuing the Professional Certificate for Construction Design is specifically conducted as follows:
1. Conditions for re-issuance:
An individual may be re-issued the Professional Certificate for Construction Design when:
- The old certificate is lost;- The old certificate is damaged;- The old certificate has expired.
2. Re-issuance dossier:
Includes:
- Application form for the issuance of the Professional Certificate for Construction Design;- A certified copy or a file containing color images taken directly from the original or a copy, and the original presented for comparison of the previously issued Professional Certificate for Construction Design. In case of loss, a commitment from the applicant must be provided.- Two 4 x 6 cm color photos on a white background, taken within the last 6 months.
3. Re-issuance process:
- Individuals shall submit 1 set of application dossiers for the issuance of the Professional Certificate for Construction Design online, by post, or directly at the competent authority.- Within 10 days from the date of receiving the complete and valid dossier, the competent authority is responsible for issuing the Professional Certificate for Construction Design.
Note: In case the dossier is incomplete or invalid, the competent authority must notify the applicant in writing once within 5 days from the date of receipt of the application.
4. Authority for re-issuance:
- Level I: Specialized agencies in construction under the Ministry of Construction.
- Level II, Level III: Department of Construction; or a recognized professional-social organization qualified to issue the Professional Certificate in Construction activities to its members.
5. Processing time:10 days from the date of receiving the complete and valid dossier.
6. Re-issuance fee: 150,000 VND (One hundred fifty thousand VND) per certificate.
7. Certificate validity period: It is the remaining validity period of the old certificate in case of re-issuance due to loss or damage; 5 years for re-issuance due to expiration.
Note: For foreign individual certificates, the validity is determined according to the duration stated in the labor permit or temporary residence card issued by the competent authority, but not exceeding 5 years.
