Procedure for Issuance of Practice Certificate in Construction Planning Design

Legal Basis:
- Construction Law 2014; Decree 15/2021/ND-CP; Decree 100/2018/ND-CP; Circular 38/2022/TT-BTC; Amended Construction Law 2020.

According to the current legal regulations, the construction planning design practice certificate is categorized into the following grades: Grade I Construction Planning Design Practice Certificate, Grade II Construction Planning Design Practice Certificate, and Grade III Construction Planning Design Practice Certificate (hereinafter referred to as "Construction Planning Design Practice Certificate").

The procedure and process for issuing the Construction Planning Design Practice Certificate are specified as follows:

1/ Issuance Conditions:

a. Conditions for issuance of Grade I Construction Planning Design Practice Certificate

- Possess full civil act capacity as regulated by law; have a residence permit or work permit in Vietnam for foreigners and overseas Vietnamese;

- Professional qualifications: Hold a university degree in one of the following fields: architecture, construction planning, urban economics, technical infrastructure, or other related fields relevant to the requirements of the construction planning project preparation.

- Experience:+ Have at least 07 years of experience in participating in construction planning design work;+ Have acted as the chief architect or head of a specialized subject design in at least 01 construction planning project within competent jurisdiction approved by the Prime Minister of the Government of Vietnam, or 02 construction planning projects (at least 01 of which is a regional planning project, a district planning project, or a general planning project) within competent jurisdiction approved by the Provincial People's Committee.

- Pass the examination requirement for the issuance of the Construction Planning Design Practice Certificate.

b. Conditions for issuance of Grade II Construction Planning Design Practice Certificate

- Possess full civil act capacity as regulated by law; have a residence permit or work permit in Vietnam for foreigners and overseas Vietnamese;

- Professional qualifications: Hold a university degree in one of the following fields: architecture, construction planning, urban economics, technical infrastructure, or other related fields relevant to the requirements of the construction planning project preparation.

- Experience:+ Have at least 04 years of experience in participating in construction planning design work;+ Have acted as the chief architect or head of a specialized subject design in at least 01 construction planning project within competent jurisdiction approved by the Provincial People's Committee, or 02 construction planning projects within competent jurisdiction approved by the District-level People's Committee.

- Pass the examination requirement for the issuance of the Construction Planning Design Practice Certificate.

c. Conditions for issuance of Grade III Construction Planning Design Practice Certificate

- Possess full civil act capacity as regulated by law; have a residence permit or work permit in Vietnam for foreigners and overseas Vietnamese;

- Professional qualifications: Hold a degree in one of the following fields: architecture, construction planning, urban economics, technical infrastructure, or other related fields relevant to the requirements of the construction planning project preparation.

- Experience:+ Have at least 02 years of experience in participating in construction planning design work for individuals with a university degree; or at least 03 years of experience for individuals with a college or vocational secondary education degree;+ Have participated in specialized subject design in at least 01 construction planning project within competent jurisdiction approved by the Provincial People's Committee or 02 construction planning projects within competent jurisdiction approved by the District-level People's Committee.

- Pass the examination requirement for the issuance of the Construction Planning Design Practice Certificate.

2/ Application Dossier:

The application dossier for the issuance of the Construction Planning Design Practice Certificate includes:

(1) Application form for the Construction Planning Design Practice Certificate accompanied by 02 colored photos sized 4 x 6 cm with a white background of the applicant taken within the last 06 months;

(2) A diploma issued by a legally recognized training institution appropriate for the Construction Planning Design Practice Certificate;
For diplomas issued by foreign training institutions, they must be legalized according to regulations and must come with a notarized Vietnamese translation according to Vietnamese law;

(3) The previously issued Construction Planning Design Practice Certificate by a competent authority in case of upgrading the practice certificate;

(4) Work assignment decisions (task assignments) from the organization to the individual or confirmation document from the legal representative of the investor about the representative tasks that the individual has completed as declared. The signer of the confirmation must be responsible for the truthfulness of the confirmed content. Independent practitioners must have contracts and acceptance reports on representative tasks performed as declared.

(5) Legal documents on residence or work permit issued by a competent authority in Vietnam for foreign individuals.

(6) Examination results meeting the requirement in case the examination was taken before submitting the application dossier for the Construction Planning Design Practice Certificate;

Note: Documents (2), (3), (4), and (6) must be notarized copies or files containing color images of the original or notarized copies and the original must be presented for verification.

3. Issuance Process:

- Individuals submit 01 application dossier for the Construction Planning Design Practice Certificate online or via postal service or directly at the competent authority issuing the Construction Planning Design Practice Certificate.- Within 20 days from receiving a complete and valid dossier, the competent authority is responsible for issuing the Construction Planning Design Practice Certificate.

In case the dossier is incomplete or invalid, the competent authority must notify the individual requesting the certificate in writing within 05 days from receiving the application.

4. Issuance Authority:

- The specialized construction agency under the Ministry of Construction certifies the issuance of Grade I Construction Planning Design Practice Certificates.- Provincial Departments of Construction certify the issuance of Grade II and Grade III Construction Planning Design Practice Certificates.- Professional social organizations recognized as eligible for certifying construction practice issue Grade II and Grade III Construction Planning Design Practice Certificates to their members.

5. Processing Time: 20 days from receiving a complete and valid dossier.

6. Issuance Fee: 300,000 VND (three hundred thousand Vietnamese Dong) per certificate.

7. Validity of the Certificate: 05 years.

For foreign individuals' practice certificates, validity is determined according to the expiration of the work permit or temporary residence card issued by the competent authority but not exceeding 05 years.
