Procedure for Issuance of Construction Survey Practice Certificate
Legal Bases:- Law on Construction 2014; Decree 15/2021/ND-CP; Decree 100/2018/ND-CP; Circular 38/2022/TT-BTC; Amended Law on Construction 2020.
According to the current legal regulations, the fields for issuing construction surveying practice certificates include:
- Topographic survey;- Geotechnical survey.
Construction surveying practice certificates are categorized as follows: Class I Construction Surveying Practice Certificate, Class II Construction Surveying Practice Certificate, and Class III Construction Surveying Practice Certificate.
Sequence and procedures for issuing Construction Surveying Practice Certificates are specifically implemented as follows:
1/ Issuance conditions:
a. Conditions for issuance of Class I Construction Surveying Practice Certificate:
- Must have full civil act capacity as prescribed by law; must have a residence permit or work permit in Vietnam for foreigners and overseas Vietnamese;
- Regarding professional qualifications:
+ For the field of topographic survey: Must have a university degree in one of the following majors: geology, geodesy, cartography, civil engineering;
+ For the field of geotechnical survey: Must have a university degree in one of the following majors: geology, civil engineering.
- Regarding experience:
+ Must have at least 07 years of experience in construction surveying;+ Must have been a lead surveyor for at least 01 project of Group A or 02 projects of Group B or higher, or at least 02 grade I or higher constructions, or 03 grade II or higher constructions.
- Must pass the examination for issuance of the Construction Surveying Practice Certificate.
b. Conditions for issuance of Class II Construction Surveying Practice Certificate:
- Must have full civil act capacity as prescribed by law; must have a residence permit or work permit in Vietnam for foreigners and overseas Vietnamese;
- Regarding professional qualifications:
+ For the field of topographic survey: Must have a university degree in one of the following majors: geology, geodesy, cartography, civil engineering;+ For the field of geotechnical survey: Must have a university degree in one of the following majors: geology, civil engineering.
- Regarding experience:
+ Must have at least 04 years of experience in construction surveying;+ Must have been a lead surveyor for at least 01 project of Group B or higher, or 02 projects of Group C or higher, or at least 02 grade II or higher constructions, or 03 grade III or higher constructions.
- Must pass the examination for issuance of the Construction Surveying Practice Certificate.
c. Conditions for issuance of Class III Construction Surveying Practice Certificate:
- Must have full civil act capacity as prescribed by law; must have a residence permit or work permit in Vietnam for foreigners and overseas Vietnamese;
- Regarding professional qualifications:
+ For the field of topographic survey: Must have specialized training in one of the following majors: geology, geodesy, cartography, civil engineering;+ For the field of geotechnical survey: Must have specialized training in one of the following majors: geology, civil engineering.
- Regarding experience:
+ Must have at least 02 years of experience in construction surveying for individuals with a university degree; at least 03 years for individuals with a college or intermediate degree;+ Must have participated in surveying at least 02 projects of Group C or higher, or 02 projects requiring an economic-technical report, or at least 02 grade III or higher constructions, or 03 grade IV or higher constructions.
- Must pass the examination for issuance of the Construction Surveying Practice Certificate.
2/ Application documents for issuance:
Includes:
(1) Application form for issuance of Construction Surveying Practice Certificate with 02 colored photos size 4 x 6 cm with a white background, taken within the last 06 months;(2) Diploma issued by a legal training institution suited for the Construction Surveying Practice Certificate;
For diplomas issued by foreign institutions, the diploma must be consularly legalized as prescribed and have a notarized and certified Vietnamese translation as prescribed by Vietnamese law;
(3) Construction Surveying Practice Certificate previously issued by a competent authority, in case of upgrading the certificate;(4) Work assignment decisions or job assignment documents from the organization for the individual, or a confirmation letter from the legal representative of the investor about the representative works that the individual has completed as declared. The signatory must be responsible for the authenticity of the confirmed content. In the case of independent practice, the individual must have contracts and acceptance records of the representative works declared.
(5) Legal documents for residence or work permits issued by a competent Vietnamese authority for foreigners.(6) Examination results meeting the requirements in case the examination was taken before submitting the application for the Construction Surveying Practice Certificate;
Note: Documents in (2), (3), (4), and (6) must be certified copies or color photo files of the original or copies, and the original must be presented for comparison.
3. Issuance process:
- The individual submits 01 set of application documents for the Construction Surveying Practice Certificate online, by postal service, or directly at the competent authority issuing the Construction Surveying Practice Certificate.
- Within 20 days from the date of receiving a complete and valid application, the competent authority is responsible for issuing the Construction Surveying Practice Certificate.
If the application is incomplete or invalid, the competent authority must notify in writing to the applicant within 05 days from the date of receiving the application.
4. Issuance authority:
- Specialized construction agency under the Ministry of Construction issues Class I Construction Surveying Practice Certificates.- Department of Construction issues Class II and Class III Construction Surveying Practice Certificates.- Recognized social-professional organizations qualified to issue construction practice certificates issue Class II and Class III Construction Surveying Practice Certificates to their members.
5. Processing time: 20 days from the date of receiving a complete and valid application.
6. Issuance fee: VND 300,000 (three hundred thousand) per certificate.
7. Validity period of the Certificate: 05 years. For foreign individuals, the validity is determined according to the period stated in the work permit or residence card issued by a competent authority, but not exceeding 05 years.
